There is a backlane and space for 4 cars behind our house.

My partner was driving down this lane, our neighbour was reversing and well the cars hit, her bumper is hanging off and my oh`s car has a damaged wing, I seen it from the kids bedroom, she got into her car and reversed within seconds, am assuming without seatbelt as she lept out of the car, started to appologised, looked up seen it was my oh and began swearing at him. now I know that me witnessing this makes no odds what so ever.

So we have never claimed on insurance before, am assuming this will classed as my partners fault?

What do we do?

Our neighbour it a bit of a aqward charactor so am assuming she will go In for whiplash and all kinds, its just the type of person she is.

Any advice please?

  • Your description is difficult to follow as you talk about your partner and your neighbour and then say what "she" was doing but I dont know the gender of either your partner or neighbour.

Generally speaking the reversing party will be held at fault for an accident if they admit to being reversing at the time. Reality is however most claim to have stopped prior to the accident and claim that the other vehicle drove into their stationary car in which case you then start looking at areas of damage.

If you feel you/ your partner were at fault then simply pass it to your insurers to deal with. They will deal with any PI claim or other elements that come from the TP

    Neighbour is 'she'

    OH is 'he'

As far as I am aware, the wearing of the seatbelt is not relevant. I beileve you are allowed to reverse without wearing a seat belt.

How on earth did they not see each other, specially the one that was going forward ie reversing lights at least.

Just pass everything to your insurance company, that's what you pay them for.
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • You are a witness - who ran into whom? Or were both vehicles in motion at the moment of impact?

Well our wing is damaged like a dent not the front of the car at all, so it makes me think she wasnot using her mirrors, I was not aware of the not having to wear a seatbelt while reversing. Thank you

You are the only known witness - were both cars in motion at the moment of impact? Did your partner sound his horn??

No he only seen her break lights and put on his breaks when he was behind her car, she carried on reversing and hit his car, and her bumper is hanging off and he jas a dint in the wing.

We just don't want to say its our fault, when its hers.

Also don't want to say its her fault when its ours.

Yes just me as a witness that I am aware off, the lane is a very tight one car at a time road, then you turn left of right in to a space, so you can only see the tail end of the first car either side..... but there is space for two on each side does that make sense?
