My contract with 02 is due for renewal early next week. On friday I received a phonecall from somebody called Daniel who told me he was from 02 and was phoning because my contract was expiring. He offered a new tarriff. At least three times during the call I asked him if it was the cheapest tarriff. He told me the alternatives and it seemed the cheapest for my needs. We agreed a deal and he sent me a form through echo sign to renew.

This morning I checked my account online and while on the 02 website I realised there was a better tarriff. I phoned 02 to make a complaint. They told me that the call was from one of their partners who dealt with business accounts and I had signed a migration order. I am not a business and I have never had a business account. I asked 02 how Aerial got my account details and was told they sometimes give business account details to aerial. 02 were helpful and have promised to investigate, but will not be able to get back to me until Monday.

I am posting this to warn others and also to get some advice please. I had a contact number for echo sign and have phoned them this morning. The woman I spoke to said she would pass this on to the relevant team on Monday, but no possible resolution was offered.

    And the moral of the story is ...seek out a package to suit you, not act upon a random phonecall.

    The issue is not so much the package.

    The issue for me is [TEXT DELETED BY FORUM TEAM]:

    1) I was misled into believing the call was directly with o2.
    2) I was misled into believing the contract was with o2.
    3) They did not tell me they were a third party company.
    4) They did not tell me this was for business contracts only.
    5) They told me migration was to a new contract not a new company.


    6) 02 must have given them 1) my number and possibly 2) the incorrect information that I am a business customer.

    I don't know, what I do know, is nobody will be phoning me uninvited to make me a great offer, so I will quickly terminate the call, I certainly wouldn't be purchasing from some random especially without doing my own research 1st. The person calling you is just doing a job, you wanted to believe so you did, many readers here are wise enough to do their own research 1st, in future I suggest you do too, whether it be a mobile phone or anything else :cool:

    "If any offers, tariffs or savings you were told about at the time of sale turn out to be untrue, you can bring a claim against your mobile phone provider under the Misrepresentation Act.
    This will allow you to either cancel your contract or to claim damages."

    And as others have said, never say yes to cold-callers. By definition cold callers are dodgy.

    Thank you herongull that is really useful information. It is definately mispresentation as o2 tell me this company is only allowed to deal with business contracts.

    So far I have emailed Offcom, spoken to someone else at o2 who tells me their policy has been breached and this shouldn't have happened. They have put a note on my account so that the new contract will not be processed. I have logged onto my online banking and cancelled the direct debit to o2 (which aerial would have used). Once I have a cancellation in writing I shall set up a new contract of my choice.

    I have to agree with grumbler. If someone choses the work in an unethical way they cannot be exempt from reprecussions. If you fly with the crows you get shot with the crows.

    I think 'unethical' is a far too soft word for deliberate misselling like this, that in fact is very close to crime [TEXT DELETED BY FORUM TEAM]. The only problem is lack of hard evidence.
