Stewart Henry, bad news as the only claim is against the actual carrier and as this was a non EU airline operating into, as opposed to out of the EU, the law does not apply. When booking flights which operate as a codeshare BA do show which flights they operate and which are operated by AA, next time stick to BA!

Hi all, anyone claimed flight cancellation and or flight delay compensation from Emirates Airlines

31/05/2016 Bangkok to Manchester via Dubai.Emirates
EK373 checked in at 18.00 for a 21.05 flight to Dubai 30 mins after check in advised flight had been cancelled. At 20.00 hrs given a new flight leaving Bangkok at 05.40 the following day 8 hrs late. Then flight from Dubai to Manchester delayed 4 hours arriving in Manchester over 12 late.

Emirates claim the A380 cancelled in Bangkok had a technical fault. Strangeone this as only around 100 passengers were in the line for new flights, and this aircraft holds near 500 I think more like EK373 had only around 100 booked and therefore put them on next flight.

I have tried several no win no fee outfits for flight delay compensation but they all say that Emirates is a non EU Carrier and Bangkok is not in the EU.

    Any help appreciated.

    Hi David,

From the following I assume, as your flight only had 100 PAX, that your aircraft was used to replace the broken Hong Kong flight. So upsetting 100 PAX instead of 500 PAX....

Emirates A380 A6-EEI Bangkok Technical Issue.
    31/05/2016
Emirates A380 A6-EEI arrived into Bangkok as EK384 from Dubai early this afternoon, however it was unable to operate the onward sector to Hong Kong due to a technical issue.

I have edited this post because as Caz3121 says, the flight originated outside the EU and is not an EU carrier of course so no claim. Too distracted while replying, no it was not booze either:)

I would just write a letter of complaint to Emirates and get some air miles for your next trip.

    Good luck.

It is difficult fighting Emirates on this issue but not impossible. I believe you would have to follow Vaubans guide and issue an LBA followed by court action. The regs are in your favour i.e it's the delay time at your final destination that counts.

Tyzap, not sure whether you misread the post but the delay was from BKK and DXB so, as a non-EU carrier operating from outside the EU there is no liability under EU261...OP could have made a claim if the flight was departing from the EU not returning to the EU

I need to either get bailiffs into enforce payment by UA, or someone somewhere mentioned a process that would require them to attend court and give financial information. and someone mentioned sheriffs? i cant find those posts, and not sure what to do next. could bailiffs get payment for me? am I just throwing money away?

If your clain is over £600 use the High Court Sheriffs. Much better enforcement than baliffs.

To those with Emirates connecting flights and similar airline issues, look at the lastest EU dictat:

Seems to go against the wording of the original regulation, and rules out what most on here thought were legitimate claims.

Sorry, I jumped the gun and assumed the linked document was another one I had been referred to fairly recently from the same EU source.

In that document, which was supposed to provide interpretative guidelines to NEBs, the Emirate's (and other's) viewpoint appeared to be upheld. See Question 4 on Page 5.
