    Then you have no claim under the Regulation, I'm afraid. There's no such protection if you fly from outside Europe on a non-European carrier.

    From Folkerts v Air France




    9 Article 2 of Regulation No 261/2004, entitled ‘Definitions’, provides:

    ‘For the purposes of this Regulation:



    (h) “final destination” means the destination on the ticket presented at the check-in counter or, in the case of directly connecting flights, the destination of the last flight;


    This appears to imply that provided departure is from a EU airport the final destination counts not the transit point as you indicated.

    I'd suggest quoting Folkerts v Air France as highlighted in my earlier post-you'll probably have to take it to a letter before action before they stop fobbing you off though so be prepared for them to still knock it back at this point.

  • Wonder if anyone can answer this one?

    We've been in a long drawn out battle with Delta over a much delayed flight from 2009. As it only became apparent last year that we could claim for this delay we have no longer got our electronic tickets, boarding passes etc.

    They are demanding this documentation before they'll look at our claim as they state that they are only obliged to keep records for 3 years.

    Any advice on where we go from here would be gratefully received!

    Try looking at the FAQs and maybe post on the right thread.

    If you don't want to do that, speak to a no win no fee firm.

    If you still need assistance after you've done your research, a "please" might get posters on your side.
