  • Deanpaul, the same thing is happening to me right now.Today is the 14th day that Natwest have yet to respond to the court.

    Since starting the process i have not heard nothing from them not even a letter saying that they will "look into it." I have called the customer relations department a couple of times but have been given the usual dialogue of having to wait 7-8 weeks for an offer letter. I chose to ignore and stuck with the timeframes given.

    I am anticipating right at the last minute for them to put in an acknowledgement or a defence. Fingers crossed that tomorrow I can put in a win by default.

    I just want to check with those who know if i am right about a couple of issues.
    Firstly, I filed 2 small claims against HSBC (for 2 seperate accounts) totalling £7972.88!! The claims where deemed served on the 11th May 07, i recieved a letter stating the bank was intending to defend the whole claim with an acknowledgement of service dated 15th May. Am i right in believing that i will have won my case by this Friday 8th June??? Do you expect i will recieve the defence this week? Shall i try to contact the bank or their solicitors?

    What do i do if i hear nothing by Friday morning post? Do i file for judgement that day?

    I am continuing to recieve charges on my accounts during the claim process - can i add these to my claim if/ when i win? Just in May alone i was charged £275 (which is more than my outgoings from the account within 1 month!! I cannnot afford to pay these charges and i am going out of control!
    If i can add them to my claim i will be very happy! How would i go about doing this?

    Any help or advice greatly appreciated:confused:

    Please read the post by Beate in the Reclaim Help Thread regarding the timings for MCOL/court. Most of the banks WILL submit a defence albeit at the last moment and the court will allow them the leniency of doing this the next day.

    You can still contact the bank within this time to see if they will negotiate a settlement, please read your relevant bank thread to see which banks will do this.

    You can't add on charges to your claim at this point as you have filed your claim with the courts.

    Yes you can press the button tomorrow but do be aware the bank are likely to put in a late defence and MCOL will accept this.

    No, not at all, just don't be disappointed if the bank enter a late defence.

    My Claims Been Issued At Court,the Court Sent It To Defendant On 15th May And It Was Deemed To Be Served On 20th May, Tsb Had Until 3rd June To Reply, When Can I Do Judgment By Default Its Not Letting Me Yet And I Cant Get Through On The Moneyclaim Number Constantly Engaged Or On Hold For Ages, Please Help .......

    Hi,
    I have just been able to request a judgement by default and my claim is now showing as REQUESTED. What should I expect to happen next?My claim is against Nationwide. Also I have just noticed that I put my name on the claim the wrong way round will this affect it at all ? Any advice would be greatly appreciated.

    How long does the court normally give for a late defence from the banks and will we be notified of this ?

    i went throufgh the mcol process and this morning was able to request judgement as i had won by default as the bank didnt reply. however i just had another look at my claim and it now says the claim was aknowledged today after i have requested judgement? where do i stand now??? please help very confused.
