I know there are two threads going for this. But the simple solution is for her to move into the rented property, sort out her benefits and for the OP to move back into the mortgaged property and get it on the market. Now, that solution is glaringly obvious.0

First of all she is not allowed to change the locks if the property is yours, so she needs to be told to give you a copy of the key. If you can't afford to pay the mortgage then don't, you can't be forced to hand over what you haven't got.... But non-payment will effect your credit rating. Contact any solicitors that offer a free half hour and write out questions that you would like answered, or if all else fails contact your Citizens Advice Bureau. Good luck!!0

Citizens Advice or the free half hour with solicitor is absolutely your best bet. I would ignore father's solicitor - blood out of a stone comes to mind!
Are you paying maintenance for the child? If not expect a letter from the CSA by the sound of it. How much equity do you have in the house? Would it be worth telling her that you have to sell it, and if she makes it awkward you will put it up for auction...0 -
