    Has anybody had any response rather than just an acknowledgement from the CAA about flights from the UK. If so how long did it take and what kind of answer did they come up with. We are still awaiting a full reply to our enquiry.

    Monarch's own conditions on its claim form are in direct contradiction to the directive.

    As we all know the directive says...

    How much compensation may I be due?Length of flight
    Delay to destination
    Compensation due
    Up to 1500km
    More than 3 hours
    €250
    1500km to 3500km
    More than 3 hours
    €400
    More than 3500km
    More than 3 hours, but less than 4 hours
    €300
    More than 3500km
    More than 4 hours
    €600

    However monach says this on its claim form...

    2) If your flight arrived at its destination more than 3 hours behind schedule, then you may be entitled to compensation. The amounts of compensation payable are:
    i) Euro 250 for flights of 1500km or less
    ii) Euro 400 for Intra-Community flights of greater than 1500km & all other flights between 1500 and 3500km
    iii) Euro 600 for all other flights
    3) Should your flight have arrived more than 3 hours after its scheduled time of arrival, but less than 4 hours, then any compensation you would be entitled to will be reduced by 50%.


    They have added their own additional rule 3) which makes no mention of the distance.

    So whilst the CAA is chasing monach over individual cases, monarch themselves have actually put into print all the evidence the CAA need.

    I sent my denied compensation claim from Monarch due to extraordinary circumstances ( Rudder problems ) to the CAA over 7 weeks ago. I have still not receive a reply9 Just on automated holding one. Has anybody got a response from the CAA to the questions of what are perceived as extraordinary circumstances. perhaps they shold add to their website to clarify or give advise on this issue.

  • There are some very useful and helpful contributors to this issue.I know the advise alays seems to be take the matter to the Small Claims Court but then why did Martin Lewis on hiis television programme 10 days ago advise everyone to go to the CAA first. Has anyone actually received any type of helpful response from the CAA

  • We are still awaiting a reply from the CAA which we sent off in November. We did receive an automated acknowledgement and that is all. So we would also be interested to learn if anybody has had a full response from them.
  • Hi, DONT BOTHER WITH THE UK CAA IF YOU WERE DELAYED ON YOUR RETURN FLIGHT TO THE UK.

    We were Delayed on a Monarch flight from Faro Portugal. Monarch rejected claim.

    CAA Say they only deal with flights departing from UK. So you have to go through the local country equivalent of the CAA if you wish to complain: What a great way out for the Airlines for half of their flights.

    Not an easy thing to do as I cant find an English version of their web site. May be this is the time to go to a specialist company who charge a fee.

    Has anybody received a reply from the CAA regarding flights departing from the UK either about extraordinary circumstances or Monarch 50% reduction. I am aware the CAA do not deal with cases for inbound flights to the UK.Thank you
  • Can I add our name to the list of people that wrote to the CAA and are still awaiting a response. It was regarding a delayed Monarch flight from Gatwick and their refusal to pay compensation. How does the CAA deal with these enquires do they write to the airline first about each individual case or do the bulk them together before replying to the complainants. Again as others have asked has anybody received a full response from the CAA. If so please could you post on this forum. We are holding fire about going to court at the moment although in the long run we may decided to take this course of action. We are sorry to say we are waiting to see the outcome of a couple of Small Claims Court cases first which will give us some indication of the way the courts are thinking.
