Parking Charge Notice

Just before christmas I was at a local retail park where there is also a Tescos. I was at Tescos fundraising by bag packing at the check outs with my sons rugby team. It was the Saturday before xmas so the car park was very busy. We had provided Tescos with our car registration numbers as we were going to be over three hours. I parked as close to Tescos as possible. I was just over 4 hours.
I have now received a charge notice from a private parking firm issuing me a penalty for being over the three hours.

I have spoken to Tescos who have advised that the car park is split and has two post codes but is operated by the same firm. I had parked in the adjoining car park and not in the Tescos one, hence my car registration details had not been logged for the correct car park. Tescos have agreed that they did not stipulate which car park we should park in, but they are unable to do any thing about the charge. They have spoken to the company and confirmed i was at their store, but they are not allowed to deal with the matter.

I have appealed to them but they have written back saying that the site is entirely seperate from the Tescos parking area and that we park there at are own risk whilst shopping else where, and Tescos have no duristrication on this site and as they have misadvised it is not a valid mitigation .

What do I do next. I was never aware that there were two seperate areas. How do I fight this?????

    I would imagine that the standard reply of 'ignore it' would apply as it is from a private company.

    Firstly who are the private parking company ?

    You now have two options :

    1. Ignore anything you get ( except the very unlikely court papers ) and go and watch the rugby.

    2. Appeal to POPLA using the code given to you by the PPC ( if they didn't give you a code then they've been VERY naughty ). This will cost them £32 but not cost you anything. You then ignore both the PPC and the POPLA result as it isn't binding on you.

    Ignore the parking company, debt collection letters, solicitors letters, anything except court papers.

    On the incredibly slim chance you receive genuine court papers, come back here for the next step.

    I've read many a forum, but can't find anything relating to company vehicles.
    I've received a parking charge, annoying thing is, i actually did pay, didn't stay over my time limit. The only mistake I made, was I didn't input my full registration number into the paying machine, just the numbers not the letters! I don't have the ticket as proof of payment. Parking Eye first contacted the leasing company, which then contacted my place of work, who then past on my details. Can I still ignore? I've already paid a handling fee to the leasing company of £18, just to send me the fine!! Any advice would me much appreciated.

    but to sumaraise:
    it is not a fine, nor is it a penalty
    check the vehicle lease/agreement for your car, this proably mentions fines/penaltys, if this is the case then you should demand your handling fee back from the company/lease company as by demanding this they are most likly to be in breach of contract.

    Well first off, it's better to start your own thread.

    You need to check the terms of the leasing company. Most will have a stipulation about charging an admin fee parking/speeding fines. BUT this isn't a fine... it's an invoice. Parking Eye do not have the legal status to issue a 'fine' or 'penalty'. As such, the lease company have no right to charge you an admin or 'handling fee' so you should demand that to be refunded.

    As for the charge itself, you paid to park so that's the end of it. Ignore any further correspondence from them.

    ...where I suggested an assertive letter to the Fleet/Lease company - in your case you've paid £18 because of their error in procedure. They (your company and the Lease co.) need to get up to speed with the POF Act; it's wrong that you are out of pocket and having to point out the error of their their own industry policies when they could simply have zero liability so easily.

    Get the PPC in your direction then turn to getting your £18 back and an assurance that they will never make the same mistake again with a fake PCN invoice.
