so this now means anne has stolen money from what should have gone to care home?! so it will now be benefit fraud?! she obviously didnt declaire correct ammount to the social as she was only paying £400 per month to home and social paid rest, this is what social services told me on the phone., as i say our families were not in contact for last few years so dont really know full ins and outs i just know what ive been told.0

Yes, and it clearly did. Taking the average, care home fees during the period in question would have been in the region of at least £400pw. (£72,800 over three and a half years.) DLA wouldn't have been paid as SS were funding the shortfall, and I think that or Attendance Allowance is stopped for people who aren't self funding.ok so nanas money.
£300 pw x 52 weeks = £15600 x 3.5 year = £54600.
-£400 per month auntie anne was paying to home =£4600 per year = £16100
so £54600 she got all together from being in home minus £16100 for fees and lets say another £1000 for hairdressing etc = £37500!
so am i now right in thinking all of that money should have gone to care home and left 320 per week for toiletries hairdressing etc??
Even if DLA wasn't stopped, it would have been used by SS to part cover the weekly fee.

Okay, I get those figures.
Were the care home bills invoiced to your Nana? Were the bills taken by direct debit? How were they paid?
The £400 a month? Or a week? For care home bills? £400 a week sounds more realistic. Which comes to £19, 200 per year. Over three and a half years, this comes to £67,200.00.0 -
If you haven't spoken to some family members, then I would be very careful of what has happened here.
My mother, has her rent and council tax paid for, this then means that her income is disposable. Aside from her bills, the rest is hers, however, she by no means has any savings.
You need the family to get all the bills, then get together all their paperwork and truly work out what has been happening with her money.0 -
but we have the statments from the post office of how much went in £300 per week , and we have the amounts paid to social services... which was only £400 PER MONTH!!! so she has stolen the rest the fees were paid by anne to social services...
so the remaining £800 per week cash taken out over the counter at post office has been stolen.
which if the amount hadn't been declaired correctly was owed to social services, she has ADMITTED stealing the remaining amount and only paying the £400 per month and taking the rest.
so there is stolen money it wasnt all directly paid to SS anne paid it, so she has obviously declaired wrong ammount to SS and stolen the rest. as i say she admits it so theres no question about stealing money we have all the statemnts of her withdrawing it....
its just who she stole it from which is now clear to be social services, they obviously didnt know how much nana was getting paid every week. so this now looking like the case do we now just take the statements to social services and they can see all the money left over that they should have had?! that Anne has admitted to spending on her self?!0 -
I suspect the £400 a month was the sum total of the monthly state pension.The £400 a month? Or a week? For care home bills? £400 a week sounds more realistic. .
Where does the £300 per week come from if nana was only in receipt of state pension? Did she have a private pension as well?.................

they didnt say , i will ring again on monday but they just said anne paid every month £400. and thats all she had to pay. but thats if social services knew the correct amount my nana was getting paid but when my ma rang DWP they said it was correct... this is all so confusing?!
so can someone just tell me please... the rest of the money from £400 PER MONTH paid to ss has been stolen from SS as they should have received that full amount leaving nana £20 per week?0 -
the payment was £300 per week in one payment from DWP and out of that she only paid £400 a month toward care home fees the rest has gone! this is where the problem is x0
