    Regarding the nursing home fees, it is possible the NHS were contributing to the home costs, see an article on the SAGA website regarding this

    Given her condition if the naughty aunty applied for the medical assessment and it was awarded, then medical costs would be covered and I think you only pay a contribution for food and board?

    That would make the £100 a week sound a correct contribution?
    Even so the extra money should have been used by the POA for the persons care/use not for herself.

    I don't know where you live, is it a small village or town? I would make sure ev1 bad aunty knows gets to hear how she treated nanna as she sounds like the type who would be so embarrassed if she thought people knew what she had been up to. Won't get the cash back, but might make you feel a bit better.

    I would pursue the DWP/social services angle to see if there was any fraud, if not an option would be for each of the other aunts to take out court claims against her. As each share is under 5k it can be small claims court so cheap and you can represent yourselves.

    The bad aunty then gets several court actions against her and at worst has to turn up and defend her actions in front of a judge over and over.

    At best she either loses or fails to turn up and defend so she gets a bunch of CCJ's against her name screwing her credit file for the next 6 years-so no more loans and credit cards for her and for someone who appears to spend money like crazy it would really stick it to her.

    The court would expect you all to write to the aunt to officially request the cash back and then if she doesn't cough up usually an official "letter before action", giving her a reasonable period to pay before you will commence court action.

    You may find just the fact you are all threatening court action pushes her to cough up or at least start a proper payment plan. If she offers a plan ask for a lump as big as she can afford up front and a signed agreement as to the total owed and the payments agreed-that way if she defaults again you have proof for the court action.

    I honestly think fraud has taken place.
    the person responsible was given POA but that does not mean she cannot be charged for commiting a criminal offence., which this situation would be, once proved and by her own admission she has already admitted to.
    All the talk about keeping it in the family and payment plan options would mean that they are aiding and abetting this person in an act of fraud and there could be repercussions.

    Hi. Just a quick thought. Do you have house insurance? I believe that some insurances come with free legal cover for people living in the house -I presume it's buildings insurance rather than contents but it might be worth checking (or checking whether work provide this for you).
    You could also try Which legal advice which is 36.50 a year although I've no idea if a) it's any good (I would assume so though) and b) whether they'd cover your specific problem
