Hi That's great news ... Im just waiting for my court date to arrive for an Orlando flight with Virgin in 2008 so can I be nosy and ask what your delay was??? Im just trying to see how Virgin are working with flights from Manchester as mine was from Manchester to Orlando too .... Thanks Trish0 -

Delayed by 259 minutes I think although it doesn't say why. How do I find that information?
The flight number is VS85, and they are claiming EC due to a hydraulics issue, i have jumped through all of the hoops and am now waiting on a court date. I will let you know how i get on.0 -

Hi Normansbaby .... I was going for mediation .... but that didn't happen and I was assigned to my local court, then I got a letter through from the court giving me a date in November for my case to be heard infront of the judge but the judge recommending mediation first ???? So I rang mediation and she said "I must have slipped through the net???" so Ive agreed to mediation and I am waiting to find out if Virgin are going to agree ... so Im not sure what to expect from mediation ????

I have received the defendants response and just wanted to check on the first couple of points they make. I claimed for my party on MCOL, they say I have no authority to bring representative action. My party is Myself, my Wife and our 2 Children - are VAA correct?
2nd, they say I have not complied with CPR 16.4 as they say I failed to provide additional particulars. I did and I have a Proof Of Delivery to their Croydon Office, however I have yet to file with court.
i intend to continue in my claim for the Pilot Illness delay from Orlando, however would be grateful of advice on the 2 points above.0 -
We were delayed by 24 hours last April on a flight from Manchester to Orlando.
We should have flown at 1430hrs, but we got an e-mail and a text at around 0530 hours to say we would not be flying today. We were already at the airport have stayed their the night before.
The reason we were given was due to a medical emergency on another flight. This other flight was using the plane allocated to take us to Orlando.
If we were informed by 0530hrs of this issue I still believe Virgin could have found another plane and crew, but just chose not to.
Now I would never dream of seeking compensation if there was a medical emergency on my actual flight as that would be in poor taste and quite rightly the regulations do not allow it. But, surely the fact the medical issue they are citing as the reason they won't give us compensation, was NOT on our flight means we should be able to claim? This is my question as I have been unable to clarify this within the regulations.
Any ideas or case law?

This is quote from their last reply. It is the last sentence I disagree with and for which I seek advice / clarification
"As an airline, we maintain that having to divert a flight, due to a medical emergency on board is classed as an exceptional circumstance. Any ensuing delays caused as a result of this diversion would then be beyond our control."0
