  • I can't seem to find the link for the Virgin claim letter. Can anyone help?
Also can I put my husband on the same claim form or do I have to fill a different one in for him?

I cant post a link as I am a new member but go to the virgin website, type in, eu claim in the search box top right and you will get to the claim form :)

I think I originally claimed for all 4 passengers separately, then later I communicated by putting all 4 of their ref numbers on any letters.

My MCOL is one claim for 4 passengers.

    Hi all,

I posted a claim in April for a 24 hour delay.
Received an acknowlegement approx 14 days later.
Then about 16 weeks later received a letter saying no compensation as this was extra ordinary circumstance (air bleed Valve on a previous flight caused knock on delay)!!
I sent Virgin Atlantic a NBA and received no reply.
Filed a claim with MCOL for 600 euros per person x 3 (myself, husband and child)
On 3 September Virgin Atlantic advised that they intend to defend the claim.
On 7 September received a letter from Virgin atlantic advising that although they do not feel that they are liable they see no value in disputes of this natue and enclosed a cheque for £2500 (incl interest and fee).
Thanks for all the info and advice on this site, its has been a fantasic help.
    :T :T :T :j:j:j

    That's brilliant ... well done ....

Without any disrespect to Maxipeeps1 .... can anyone tell me how Virgins head works???? Our Extraordinary Circumstance was an Air Bleed Value ... so how can they pay out for Maxipeeps if her flight was due to a knock on effect for a previous flights air bleed valve but they want to go all the way to court with ours and it was our plane that was affected?? Im thinking of emailing the woman at Virgin who is dealing with our case ... Yes or No???

    Thanks x

Well done! Just received my Acknowledgement of Service today saying they intend to defend so I hope I have the same outcome as you!

Been away a little while and upon checking in again I see that a flight delayed from Orlando (where I was a week previously) is delayed again due to pilot illness (like mine was) and VAA decide to pay out. Same place same problem but different outcome - what am I not seeing that VAA obviously are?
This just confirms to me that staff sickness cannot be considered as "extraordinary" and VAA have decided that an aircraft going to any other destination than one of their hub airports is exempt from compensatory payouts!!

I really hope their defence is a good one as I would like to think that a judge would make an example of whoever gets the job of standing up and presenting it!! Without giving too much away and upon reading quite a lot of correspondence I'm hoping the judge will just laugh and order a payout.............plus expenses and a further compensatory payment for wasting everyone's time and effort!!!!

We too were on this flight (on 7th) and are going through the motions now.

Having called Virgin to query the difference it seems that the flight the week later delayed due to pilot sickness was in fact as a result of the pilot on the Gatwick - Orlando flight falling sick, which then impacted the Orlando flight back. Hope that makes sense! So those delayed on the Orlando - Gatwick flight were delayed due to sickness - but not actually on their flight!!

Either way sickness is sickness and is either extraordinary - or not. It can't be extraordinary determined by which country it happens in!

Neither sounds EC but I guess a knock on is less EC, being one step removed, if you get me. Good luck with your claim anyway.

We were on the Orlando - Manchester flight 7th June delayed for 25hrs due to pilot sickness.
We have been through MCOL and VA are defending.
We are waiting to hear about mediation but have received a letter today saying that our hearing has been moved from our local court (north west) to Horsham.

Our local court said that as the letter had only arrived they would try and get it moved back to the NW. However they came back and said it wasn't possible. That the hearing will be in Horsham as there are multiple hearings relating to that specific flight so they are doing them all in one day!!!!!

  • Oooh, I hope the first case is conducted by a LIP with some knowledge, as otherwise it could be a pack of cards behind it.

Is this the court working to Virgins benefit? Horsham is v.close to Crawley so why should Virgin get a local court but claimants have to give up an entire day, some will certainly have to give up 2 for travelling. Wouldn't it make sense to have a NW court gven it was a flght to Manchester?
