Some great info here but still not quite sure on things.... sorry!
Had the VS replay - the aircraft scheduled to operate our flight had unexpected tech issue during its previous journey with the engine electronic control unit - discovered just before it departed India. Part wasn't immediately available - but fault finally rectified allowing aircraft to continue to London.
Good old VS rearranged their fleet to minimise delay so we could continue on our journey - although that did give us a delay of 12 hours before we left London.
Not sure if the part at fault is EC - VS say it was unforeseen and not inherent in the normal operation of the aircraft.
As this was all on the flight before our flight are we wrong to take this further?
Can't find anything about the actual part making it an EC or not when it fails.

You should have been sent a copy of Virgin's preliminary defence, within 28 days of the initial action being served on Virgin. (This will be perhaps a two page document).
The allocation questionnaire comes next, which you have just filled in, requesting the claim be put on the small claims track and heard in your local court. (And whether you are content to have mediation.)
Next will be in a few weeks when the mediation people will get in touch (at which sometimes the airlines settle, but often it's a bit of a waste of time). And following that you will get a date from your local court for a hearing (with a deadline for the submission of your bundle of paperwork). But that will be a few months away, most likely.

I selected the mediation option so why will I get a date from the court for a hearing?
How do I prepare for the mediation phone call? Will I get a date for it or does it come out of the blue? Do I have to research Wallentin-Hermann which others speak of, as currently it is all gobbledegook to me?
Do I have to pay a hearing fee if it goes to court considering I chose the mediation option?
Thank you for your help guys, I feel like a fish out of water and will be stuck for words if I get a call, but I feel determined to follow this through.0 -

I agree with Haslehust. I do not like the idea of the hearing being in Horsham probably using the same judge for all cases heard. This does not feel right to me.0 -

Me neither, if there are a number of cases all together they will probably go with a big legal team. They are certainly determined to defend our flight. I won't give up but looks like we are going to have to travel0 -
Today we asked the local court if it could be brought back up to NW. They said as the judge has sent it down there we'd have to go down there and have a hearing in front of the judge to bring it back again :mad:0
