so extraordinary circumstances are, acts outside of the airlines control ie act of god, terrorisim, weather, but technical faults are when bits of their aircraft stop working and they can't fix it fast enough and it has no relivance on which bit it is.0 -

I read on another forum that a modern commercial plane has 6,000,000 moving/working parts. There is a fair chance that the same part has not previously gone wrong!0 -

Exactly - airplanes going tech dont count, unless (as Wallentin says) the problem was something not inherent in the ordinary business of flying and beyond an airlines control - like a terrorist attack or a fleet-wide hidden manufacturing defect (like Dreamliner batteries, for example ...).0 -
Is there anyone who took this delayed flight, February half term 2007? and can give me flight details etc., Went with the grandkids and had a long delay at Gatwick. Thanks0

Has anyone flying on VS052 Grenada to Gatwick on 7/4/2011 made a claim following the 22 hour delay. The plane developed an oil leak at Tobago flew to Grenada and then was diverted to Barbados, leaving all passengers there until next day while the plane flew home with only crew onboard. Virgin refuse to pay compensation. Have done the NBA and received a letter claiming "exceptional circumstances". Next step MCOL ?0

Excuse is normally due to extraordinary circumstances but yes MCOL is the next step.0 -
Cannot believe it. Virgin have filed a defence to my claim citing that a crack to the flight deck windscreen on the previous flight is defendable by extraordinary circumstances. I can not see how they can possibly claim this as if the did then the likes of autoglass would definitely be out of business!!!!! I know it is not the same thing, but these things happen. They do not even know how or when it happened it was just apparently suddenly noticed before the flight took off. I have sent in my allocation questionnaire and am thinking about filing a reply to their defence pointing out the ECJ case again as it was the previous flight which was effected. So annoying. It is another £40.00 added onto the claim in allocation fee.0

This is identical to my own delayed flight - where a crack discovered sometime before take-off on the previous flight caused a delay of 24 hours. Frankly it is pathetic an airline should try to defend this.

Hi all
After being given a court date in November, Ive also been referred back to Mediation as "I slipped through the net" on the last attempt but the judge recommends mediation so Ive agreed and Im waiting to hear if Virgin agree so in the meantime, what should I expect from mediation?? Can anyone that has gone to mediation tell me what will happen please??
The woman I spoke to when I was agreeing to it said I would have an hour but only half of that was to state my case but the mediator doesn't get too involved in the case???? and the other half is negotiating??? So what do I prepare?? How indepth do I go if this mediator isn't going to get too involved?? Do I presume they know the law or even anything about my case before I get on the phone???
If virgin agree, will I get a call to say Mediation will happen on this date at this time or will they just call me and off we go during that phone call??? Im not sure what to prepare really.
