Hi this is my first post after reading this thread, and following advice of fellow claimers I would like to share my case, and also seek further advice.
Gatwick - Orlando Oct 12 2008
Delay 24 hours
Flight no VS27
We were made to hang around the airport from after checking in our luggage at about 10am until about 4pm, with no information or decision on when or if, we would be flying that day. Finally an announcement was made to say the flight was cancelled until the following day (but didn't know when!). It was a very stressful and disappointing day.
I initially wrote to Virgin on 22/4/13 and received an 'extraordinary circumstances' decline on 15/5/13 saying "an unexpected technical problem with the main landing gear prior to departure, and the replacement aircraft was unavailable as it was undergoing routine and regulatory maintenance checks".
After sending an NBA I then did a MCOL, Virgin are defending my claim
So the latest is, I have returned the "Small Claims Directions Questionnaire (Form N180)" plus paid an additional to my MCOL fee of a further £40 "allocation fee". I ticked the mediation option and now await their response.
What do I do now? Just wait?
I can't find any other claims on this forum with the same flight.
Has anyone got any mediation experience they would like to share?
Any advice would be gratefully received
I do hope I have done the right thing, others have been paid out before reaching as far as I have got to, and I hope I have a claimable case?0 -
Just a quick question, I have filed a claim and received back the Directions Questionnaire, which I am just filling in. Just wanted to check, as my claim is less than £1500, I don't have to send any money to them, is that correct?

On my covering letter entitled "Notice of Proposed Allocation to the Small Claims Track" there are numbered items telling you what to do, on my number 4. it said I had to pay an allocation fee of £40 (my claim is £2900). It went on to say that if the fee was not paid the claim will be struck out.
Maybe its worth a call to check if you are unsure.0 -

You should have been sent a copy of Virgin's preliminary defence, within 28 days of the initial action being served on Virgin. (This will be perhaps a two page document).
The allocation questionnaire comes next, which you have just filled in, requesting the claim be put on the small claims track and heard in your local court. (And whether you are content to have mediation.)
Next will be in a few weeks when the mediation people will get in touch (at which sometimes the airlines settle, but often it's a bit of a waste of time). And following that you will get a date from your local court for a hearing (with a deadline for the submission of your bundle of paperwork). But that will be a few months away, most likely.

Does anyone know how i can find the flight number for a flight from Manchester to Las Vegas on the 14th May 2011 that was delayed for 5 hours?
I have no booking ref number and haven't a clue where to start looking.
I think the delay was due to having to wait for a part. I clicked on the flight stats link but it asks for a flight number which I haven't got.0 -

Delayed by 259 minutes I think although it doesn't say why. How do I find that information?0 -

There's was a Virgin flight delayed for over 4 hours two days previously, but otherwise I cannot find anything either.
Katelina: are you sure about the dates? And who did you fly with?
Our posts just crossed: so start your claim in the normal way. (You don't need to find the cause - Virgin will tell you). Lots of reading for you to do, though ...0 -
Thanks Vauban.....now to find the claim form again. Do you just leave it blank where it asks the reason? Sorry I'm a pain. Also can I out my husband on the same claim or do I send a separate form in the same envelope for him?0

One for a Man - MCO 8 hour delay 2009, one for MCO - MAN August 2012 for 12 Hours and the other Manchester to Las Vegas 28th April 2011 for 3 hours 59 minutes!! Its for 10 people so a healthy claim. Is it worth sending individual claims or sending all three together or irrelevant? Many thanks all0

3 separate claims as all 3 circumstances will be different. Why don't you do them individually as time is on your side?0 -
I have filled out relevant claim forms individually but thought I'd send them per trip ie family of 4 1 delay etc?0
