Thanks for all your help so far guys!
I have now filed with MCOL and just wondered what sort of time frames it usually takes Virgin to respond?
So far have many case been settled before court? It would be much easier that way but I am more than happy to proceed to court if necessary!0 -

NBA letter giving them 14 days to settle - then start court proceedings.0 -
I used ......
In addition we would also point out that in the case of Finnair Oyj v Timy Lassooy CaseC-22/11, at point 37, it clearly states that;
" In addition, it is apparent from recital 15 in the preamble to Regulation No 261/2004 that ‘extraordinary circumstances’ may relate only to ‘a particular aircraft on a particular day’, which cannot apply to a passenger denied boarding because of the rescheduling of flights as aresult of extraordinary circumstances affecting an earlier flight".
Hope this helps
Thanks for providing this quote, it will help my case. I have finally got round to issuing my NBA today. I'll let you know how I get on in due course.0 -
Just wondering if anyone has received compensation in respect of a delayed flight from a destination rather than a home base airport. Seems virgin are paying compensation for pilot sickness from Gatwick but refusing pilot sickness for delays from Orlando as extraordinary circumstances:(0

I am absolutely disgusted with Virgin Atlantic.
My experience of this airline I am sorry to say is filled with their staff at all levels being dishonest and twisting things to the airlines advantage.
I have never dealt with an organization which clearly has no respect for its customers quite like Virgin Atlantic
The airline and organization from the top down are a true law on to themselves, they have no interest in passengers.
Virgin withheld medication from passengers for over 20 hours in florida. Passengers asked for access to these meds which virgin stringently denies happened. I have told Virgin time and again that we were denied our meds, now the airline have stated that they asked all passengers if we needed our luggage off the plane for medication etc, which is a complete and utter fabrication of what actually happened. I have never dealt with such dishonest practices from a huge organization.0 -
Surely someone video'd them denying you the access to Meds?0
-
I wish we had video'd them, I guess when it's all going off though you don't think about doing sensible like that. There were many witnesses though, and I know that others had there boarding cards signed by the manager who asked them to return the following afternoon. If honest it was do chaotic that we had enough on dealing with the rude and aggressive staff. I have brought this up many times with the airline and now they have started to make things up which did not happen. I'm feeling very annoyed and frustrated if honest, and the airline are more than willing to go to court0

Just a quick note that I successfully claimed for 3 passengers on the VS16 flight from orlando to gatwick due to take off on 15/06/13 but was delayed 24 hours.
I put in my claim via email, after 10 days I was told I had to send it to an office in Luton (i think).
After about 3 weeks I received 3 cheques, each for £515.happy days
thanks for the help provided on these forums.
