I am so pleased that this has finally been settled without going to court.
I will be happy for anyone else claiming for the same delay to contact me for more information.
The flight in question was VS043 to Las Vegas from Gatwick on 27th August 2012

In the excitement of receiving my cheque today, I forgot to thank everyone on this forum who has helped me in my case. Without all of the help and encouragement I received I may not have now been £1000 richer. Hopefully my story has helped others get what is due to them. I was really worried about going to court, as Virgin seemed to be defending my claim against them but paying most of the others at the last minute. If it had come it though I would have gone. Like I said in my earlier post I will be happy to help anyone claiming who was on my flight and had to spend that awful hour or so in the pouring rain outside the Gatwick Hilton when the fire alarms went off! Congratulations to everyone who has recently received their compensation. I am pleased to see that Virgin are now taking some responsibility for "crew issues". Hoping this will help the passengers of VS74 Orlando to Manchester 25 hour delay due to Pilot illness. Virgin are adamant they are not going to pay out for this flight. Going to start my court action at the weekend!!0

Lets hope VA see sense and begin to treat us like human beings, rather than as an irritant, which seems to be VA's current position0

No of course it's not a valid reason and it's just part of the standard fob off games that they play.
The normal advice would be to NBA and then court, but as you've asked the question in the first place, - forgive my bluntness - but are you confident and knowledgeable enough to take this through to court on your own?
You would have *known* that the answer was rubbish if you had thoroughly read the FAQ's is what I mean.
Anyhow, you don't have enough time to engage a NWNF firm, so you either NBA today and go for it, or walk away.
You *must* file the court claim before end of working day, Friday 23rd August for the claim not to be out of time (IMO)

Are there companies that will handle the claim for you? After receiving the usual Extraordinary Circumstances letter which is not valid I do not feel confident enough to attend court etc myself. This is obviously what Virgin are hoping for, I know a company will cost but is something I would like to consider further.

Delayed flight 10 May 2012 VS16.
Sent claim form in for this flight a week ago for 3 adults and just reading through the forum I see others have already received compensation for this flight. Will this make my claim quicker to process or not?0 -

Hi folks,
after a quick bit of advice myself - originally wrote a request via letter in dec '12 which was returned with a 'you need to follow our procedures' (despite it having all relevant info therein). Sent their form in in Jan 2013 in ref to a flight in 2009, got the confirmation of receipt then nothing.
wrote an NBA approx. 6 weeks ago, and no response, but a few days ago received a formal declination through EC letter citing damage to one of their aircraft, and with no spare aircraft having to re-arrange their fleet.
My understanding is that this does not qualify as EC, and hence will contest it (probably using the finnair case as reference), and issue another NBA letter (which I think I don't technically have to do, but will). I have seen a number of references to claiming interest at 8% pa, but presumably this only becomes applicable at the MCOL stage? If not, should this be included in the NBA letter, as on a compound rate it would significantly increase the claim?
