    2 cheques for £515 each arrived today from Virgin, I sent off their claim form and was waiting for an excuse back as to why they would not pay, instead they just sent the compensation!!!

    Thanks to everyone on here who gave me advice- did not even need to send a NBA in the end.

    No they did not initially deny compensation.

    I originally sent a letter to which the reply was please download print off and send back the EU compensation form on our website. This I did and 3 weeks later I received 2 cheques for the equil of EUR600 in full settlement of my claim.

    Reason for the Delay was pilot was sick before the flight resulting in a 24hr Delay

    Great news for you Gavvy, really pleased for you. I have just checked my MCOL and VA have entered a defence citing exactly what they seem to have paid you for. Looking back over my previous threads you will see my flight was delayed for over 24 hours due to Pilot illness. It seems funny for them to pay you and dispute/enter a defence against my claim. Seems that VA has a "left hand not knowing what the right hand is up to" scenario going on here.

    By the by I'm not exactly sure what happens next, ie with the court action.......do I just let it run it's course and see what happens or do I need to press the court for a judgement? Any advice or guidance would be gratefully appreciated.

    It would seem like VA are treating the VS74 quite differently to those that have been delayed by pilot illness. I have noticed however that they claimed extraordinary circumstances (EC) with reference to a delay experienced at Gatwick. VA originally claimed EC due to a Caribbean storm, then after realizing that passengers had already been told it was due to pilot illness, changed the story but still claimed EC, I wonder if that flight was ever paid out?
    I have been in touch with the customer relations manager, and other directors. I tend to be ignored most of the time, but have actually been offered flowers and high street vouchers when I asked them to explain why they denied passengers access to luggage, but more importantly medication for my disabled mother. I have responded telling them to keep their vouchers and flowers and that I want the compensation owed to my party, they have again ignored my emails until yesterday when I sent them my MCOL. I wonder if we should now contact VA explaining that they have since paid out on Pilot illness??

    (And very sorry if this has already been answered elsewhere!)

    I have a claim against VA that's just come back refused.
    25 / 09 / 2011 London to Sydney via Hong Kong.

    The reason given is Extraordinary Circumstances (obviously!), but what I'm interested in is the reason given as sickness. Specifically, the inbound flight was cancelled, "...because some of the crew were unable to operate the flight for medical reasons."

    If one pilot was ill I've seen some claims succeed.
    And if one crew member was ill the same... BUT does having more than one illness at a time mean they don't have to pay?

    If so, they're on a pretty tight business model to say that having two employees on the same flight ill is impossible to manage around... It's fair to say I'm a little disappointed after being stuck in Hong Kong for four hours!.
  • I and my family were also on flightVS74 from Orlando to Manchester which was delayed for 25 hours because of "pilot sickness". I have also been denied compensation because of "extraordinary circumstances". I have issued an NBA and if I do not hear from Virgin next week I will issue an MCOL. It is very interesting that there is no consistency in Virgins approach to compensation. I think they rely on people "chickening out" from court action. Having seen the post to say that they this week paid out on a claim based on pilot sickness, suggests to me that they are confused.

    I have also issued my NBA letter for the Orlando to Manchester flight delayed 25 hours on 7 June. I will start court action next Monday if I have not received a reply, which I doubt I will as every letter/e mail I have sent to Virgin has been ignored. I don't understand how they can claim extraordinary circumstances for our flight then pay out compensation immediately for the Gatwick flight which was delayed for the exact same reason just a week later - pilot sickness!!:mad:

    Ive checked on there though and it states that the plane was delayed at gatwick too, so has it was already delayed at gatwick to come and collect us from vegas, do I not have a case for a claim?
