Yes you now write back and tell them not to be so ridiculous, of course fixing a common fault with an aircraft that has a high degree of technical sophistication, - no matter how unpredictable that fault is - is an inherent part of the running of an airline, so that if they don't reconsider and pay the rightful compo amount claimed within 14/21 days then you'll have no option but to commence a court claim for recovery, where interest and costs will also be claimed.

Do i put these words as another letter, or straight into the NBA letter?
    Many thanks for your help
  • Can anyone tell me if they have successfully claimed on flight VS0065 on 7th October 2088.

I have just been declined by Virgin on the grounds of extraordinary circumstances.

Surely a flap problem should have been discovered and fixed long before scheduled take off???

Hi guys, can anybody help with my question...

I booked through LAST MINUTE.COM and flew with Virgin in sept 2008, I booked for myself and three friends and we were delayed from Las vegas to london on the way home for around 4-hours.
As this was not booked direct with virgin, what's my stance on claiming for this?

You claim from the airlines directly as normal. Doesn't matter if you booked with someone else.
  • Hi
I was delayed on a flight from Gatwick to Las Vegas last August. Firstly we were told that the aeroplane was damaged on it's way back from Colombia or somewhere and we were going to be on another plane which was undergoing safety checks. Every time we looked at the departure board it was delayed a few more hours. Eventually we were told that although the plane was ok to take off, the flight crew were unable to work as they would be exceeding their duty hours. Surely this means we can claim? Instead of taking off at 11.35am on Thursday, we took off at 10.10am on Friday. We were put up in the Hilton hotel at Gatwick (where the fire alarm went off at around 11pm and we all had to stand outside in the rain for an hour while the fire crew checked it out)
I did complain and received 12500 Virgin miles each for myself and my husband, but I have written the template letter which was on this site and am still awaiting a reply (12 days ago so far)
Hopefully I will receive something but if I am told that I have received the air miles instead I will ask them to take them back and give me the money!
I will update this once I receive my reply.

    Hi,

I have read all your updates with great interest as my husband and I were also on this flight. We were actually getting married in Vegas and the delay didn't just cost us a day of our holiday but we had also to rearrange our meeting at the chapel and try and contact family who were already in Vegas waiting for us! It was a total nightmare and marred the start of our wedding and honeymoon! Not to mention that we paid for one night at MGM which we didn't use and they then fined us for not being there!

We did actually complain via email the day of the cancellation from the hilton but were fobbed off. We were also giving airmiles but I'm really keen to push for compensation as the whole situation still infuriates me, the Virgin staff were incredibly unhelpful when dealing with a tearful bride to be!

I'm going to fill in the compensation form tomorrow and I'll share any updates!

Thanks for sharing your experiences, it has encouraged me to try!

    Just come across this thread.

I had a 7 hour delay on a flight to Boston back in Nov 2007. The original reason given was technical, and then crew ran out of time so had to be replaced.

Have filled in the form, not expecting anything, but no harm in trying.

Will update when/if I have some news.

Had nearly forgotten about this, as I had not heard a thing from Virgin since I sent the original letter in Feb, but to my suprise there was an envelope with the Virgin logo waiting for me when I got home from work tonight, and inside was a cheque for £521.

More than happy with that, also pays for the flights I have just booked with them for September.

By using the wording of giving them 14/21 more days to reconsider or else you are off to court, you are effectively composing a NBA letter.
It doesn't have to be as per the template.
You just write and say you disagree with the nonsense, urge them to reconsider, and that if they don't within the time frame you give them (minimum 14 days) then you'll be off to court without giving them further notice.

Come to terms with the fact that this is a civil matter, and that the airlines DO NOT get to set the time frames for the letter writing games.

    So, the quickest way to get something done, is;
    1) You write and claim.
    2) irrespective of a reply, you write a NBA after a minimum of 14 days
    3) commence claim after 14 days

Only then, by the court being a higher authority, will you start to get 'proper' answers.

Thank you, I have typed up the NBA and I will get it posted tomorrow.
I look forward to their response And will report back

How do you search and find the flight number and delay time? Mine was back in 2008 (about 4-hours) but I cannot locate flight number and time/delay time!
