Having already sent NBA letter etc, I also sent a letter, which included the original receipts for out of pocket expenses over and above the meal vouchers we received courtesy of VA. After all my party was stranded in MCO for the best part of nine hours whilst we waited to board. I have received a reply to an email I sent asking for an update stating the "exceptional circumstances" thing!!
How can VA customer services get so mixed up with what I'm claiming for and what I'm not? I fear that the original receipts will now be "filed away" and no record of them will be found and I will stay the best part of £60 ($90 odd) out of pocket.
Any suggestions as I have tried in another email, to point out the misunderstanding?

A NBA letter should only be sent if you mean it. On the assumption you meant what you said i.e. if you don't pay up I am taking you to court .... my suggestion is...... take them to court.
The NBA has already been forwarded to VA, I sent a separate claim in letter form including receipts. There has obviously been some sort of misunderstanding at VA as I have received the decline of claims reply to an EU 261/2004, which wasn't my claim this time. I was claiming out of pocket expenses.
My fear is that letter and receipts may now be lost and my claim no use whatsoever.
With regard to the NBA, the soak period has not elapsed as yet so no court action.............yet!!0 -

Copies of receipts should only have been sent. The airlines can easily claim they have never been received and you cannot prove otherwise. Even recorded delivery only provides proof that an envelope was delivered - not what was in it. Good luck with your delay claim.0 -
I decided to pursue a claim against Virgin and started with filling out their claim form (which I downloaded via their site), I sent this off and received the obligatory stalling letter.
My EU compensation form was dated 14th April.
Virgin first response 20th April - stating 6-12 weeks before response.
I then wrote on 11th May stating I look forward to receiving their remittance within 6-12 week timescale.
Virgin second response 13th June 2013 stating 'extraordinary circumstances'
I wrote again on 17th June with my NBA giving them 14 days and stating that I didn't think this was extraordinary circumstances
I received no response and therefore proceeded to Money Claim Online and put in a claim for 2 x persons @ £508 each plus 4 1/2 years interest
Virgin responded within 7 days of claim with Acknowledgement of Service and said they would respond fully within 28 days.
This was on 12th July.
Today 19th July - I received a letter in the post from Virgin together with a Cheque for £1,505.60 stating that they do not accept blame but do not wish to proceed to court.
RESULT!

To those still waiting - do not delay - issue that 14 day NBA and proceed through courts.0 -

Ive sent our mediation forms back last week and still heard nothing and nothing showing on the MCOL website but I was thinking exactly the same ... why are others receiving their settlement and not getting to the same stage as us?? I don't want to have to go to court but I WILL!! Its a bit scary really.0 -
Is there any advice on filling out the mcol form? do I need to do this per person or can I put a claim in for the family? is there a thread on this?0
