    Letter in the post, checked last night and i got my "We'll get back to you in 12 weeks" letter in the middle of January and still no response, not even the "Technical Issues" letter.

    Legal action here i come i think!

  • Hi, a quick question. Virgin have defended claim and i now have the 2Directions questionnaire" to complete.
    It asks which County Court I would like the hearing to take place. All correspondence so far has come from Northampton County Court,that location is ok but I do have one nearer in Huntingdon.
    Does anyone know if there is a prefered location for these cases to be heard? It may not go that far but I fully intend to go to court if necessary.

    Choose whichever court is most convenient for you.

    Have today had a call explaining mediation and trying to set it up for when I'm available. Has anyone got to the stage I'm at and still received payment from Virgin before mediation or before a hearing?

    Also if it does go to mediation or a hearing what should I be collecting evidence wise to support my case. Their defence is based on technical issue and staff legal hours. Thanks again.

    I don't understand mediation in the context of these claims. In the case of flight delays, surely either there's a valid claim or there isn't; I can't see any "middle ground" which is what I (probably wrongly) associate with mediation. Is this just some kind of Court hearing but without the judge where the parties try to convince each other?

    You're right mediation in these cases is a waste of time.

    Thanks, thought so but I presume you need to play the game to show you have tried to resolve without "wasting" the court's time.

    In a word, no. They can't dictate how you communicate. If you can easily/quickly cut and paste extracts from your letter, it might be easier to do that than argue the toss. Having said that, if that means you go to the back of the queue again, that's unacceptable. They really must be struggling for a defence if that's their best response though!

    How long did you wait for the response, as a matter of interest? I think I'm on day 27.
