In a word, no. They can't dictate how you communicate. If you can easily/quickly cut and paste extracts from your letter, it might be easier to do that than argue the toss. Having said that, if that means you go to the back of the queue again, that's unacceptable. They really must be struggling for a defence if that's their best response though!

How long did you wait for the response, as a matter of interest? I think I'm on day 27.

Ok to keep things simple i will fill in the forms, annoying though as its basically what ive already given them.
I suppose they hope i/we will give up!

I've been waiting longer than 3 weeks too so obviously they are not answering in the order received! (I sent a good old fashioned letter, too, by the way!)

May have only been 3 weeks but it looks like it is just a std letter that they send to all? Maybe just to slow things down...

14 days today since I sent my NBA, is this all I had to do before going down MCOL route?

So long as you are happy all 'served' correctly then yes but you may just wish to give it a week or so just to give them a bit of leeway.

Have today had a call explaining mediation and trying to set it up for when I'm available. Has anyone got to the stage I'm at and still received payment from Virgin before mediation or before a hearing?

Also if it does go to mediation or a hearing what should I be collecting evidence wise to support my case. Their defence is based on technical issue and staff legal hours. Thanks again.

    hi
I had exactly the same as you, asking when I am available for mediation. I told them the days and they said they will speak to Virgin and get back to me. Two weeks later and I hadn't heard back so I rang the mediation team.. I was told the case had been transferred back to Northampton and I would be hearing from them re which court the case would be heard in. They chased this up for me and I then received a letter saying the case would be heard in the court I had opted for and I would receive a date in due course - that was about three weeks ago and I am still waiting!
Virgin's defence is also technical issues and staff legal working hours - can't believe they still haven't settled this!

Well I have today heard that the mediation is set for next week so slightly different to you. Not sure if I need a full defence for mediation as like others have said surely Virgin will offer to pay costs and I will waive interest. Would of hoped Virgin settled by now for you and me. Others are saying they received settlement way before they got to the stage we are at. What's up with us?

I have today received Virgins defence from MCOL. They are still claiming technical delays from the privious day as extraordinary circumstances. They dont even have the correct information in their defence as they have the wrong flight!!
