Can I ask you a question, I have a problem with Virgin. They have replied and are now asking for more detail. The details they are asking for I have given them already, apart from one, which is the Booking Reference! did you have to give the booking REference, my probelm was back in 2008 so I don;t have it now

They can refuse on whatever grounds they like, but that doesn't mean they're right!
You can certainly still issue court Proceedings without a reference number. Once Proceedings are issued you can prove you were on the flight by writing a short witness statement to that affect.0 -
So I have a reply from my letter.... asking me to fill in a claim form that was hidden on their website, Is it best just to do this- I have already given them all the info on the form in my previous letter, so should I now send a NBA?0

I personally never complete the airline forms, there's simply no requirement to do so.
The only legal requirement is that you provide them with all the information necessary for them to investigate the matter.
By all means send the NBA, but only if you're happy to follow through with it.0 -

That's fine, give them 30 days after having received all the information they'd need, after that send a final NBA and then issue.0 -

Hi,
We were a party of 4 due to return to LGW on VS0016 departing MCO on 31st August 2007. The flight was cancelled. At the time we were told by VA ground staff in MCO that it was due to technical problems with aircraft scheduled to operate our flight. We travelled home on VS0016 the following day arriving at LGW 24 hours late.
Following the advice on this forum I submitted 4 claim forms to Virgin and have now received their response
Is this the right course of action? Any advice would be greatly appreciated but as you can see time is of the essence if we are not going to fall foul of the 6 year limit.

I sent the NBA to their EU claims address, was this the place to send it or should I have sent it to their registered address?
We are also claiming (NBA sent) for the flight out to MCO on 15/8/2007 as that flight was aborted during take-off and we were delayed almost 6 hours. Their reason for declining was EC 'because of a defect with the Number 2 engine which came to light as the aircraft was in the process of taking off'.
How long do you think I should wait before filing a claim on MCO?
Also, can I put both the above claims on a single MCO claim or should I do them both separately?
Is it worth sending a letter to the company secretary at their registered address indicating my intention to now commence legal action?
Thanks in advance and appreciate any advise on the MCO claim process as well.

Did you give them 14 days to respond to the NBA, if so wait until the deadline and then start proceedings. If not send a letter with a copy of your original with a further 7 days to respond with a satisfactory offer, what you are entitled to.

Yes I did give them 14 days notice but think I will send another to the company secretary giving them 7 days as you suggest.
I'll do it for both claims as time is of the essence now.
