  • Good morning,

    We were on the above flight from Orlando on 22nd June which was delayed for 27 hours due to a 'technical problem' with the plane.

    An email was sent to us 10 hours before the flight took off advising us of the full delay, we were put up in a hotel, given meal vouchers and airmiles for the delay.

    As we accepted these - is this enough for them to not pay compensation?

    You should be entitled to 600 Euros per person, in addition to whatever assistance was provided locally. Have a read of others' experiences on this thread, as well as the FAQs on page one. You'll see you are likely to have to start legal procedings before Virgin takes your claim seriously, but once you do the chances of getting your money are good.

    As has already been stated upthread, if you want the compensation owed you will need to issue a legal claim after firstly writing a NBA giving the airline 14 days to settle your claim.

    Can I sent the NBA in response to the email they sent or do I send it by post? If the later is it the address in Crawley mentioned by other users?

    If I don't get any compensation this way I am going to then use a NWNF company as I can't be bothered going through court for 200 euros. Would that be the correct sequence? Or should I go straight to the NWNF company now??

    Quick update, I posted my NBA letter yesterday naming all the full paying passengers in my party, ie my partner, son and myself. I am also going to check my household insurance to see if that covers me for the foreseeable court action ahead.

    I would like to know if any of the seasoned forum members agree about a group complaint, whether it would be a good idea or just doing it as individual claims? Any further advice would be gratefully accepted as I have declined writing to the CAA due to the time taken to get a reply. Many thanks.

    It's fine for you to name your partner and juvenile in your MCOL statement. I doubt your insurance will pay for you to initiate a small claims court action - but it's not too dear, and you get it back if you win (as you are likely to).

    Thanks for the reply. I was also wondering what the thought may be if all the remaining passengers from my flight who are seeking advice, were to club together so to speak and forward a joint claim against VA? I am happy to assist in anyway possible just as I am happy to proceed with my own claim if that's my only option. Again any advice would be appreciated. Thank you.
  • Hi I flew to Cyprus just over 2 years ago with my family on the return journey we were delayed about 17 hours we had to collect our luggage and Thomson put us in a hotel for the night we were told lots of different stories about why we couldn't fly eventually they said the door wouldn't shut properly and an engineer was being flown in from another airport but by the time he arrived the captain had run out of hours so couldn't fly anyway , when I returned to then uk I wrote and complained to the Thomson then I saw on the tv Martin lewis saying you can claim if you were delayed more than so many hours so I did it took 80 days for my reply to come and tui travel say that because I didn't mention the E U regulation they wont consider my claim has anyone else had this response is it correct or are they just hoping I give up if anyone can help I would be very gratefull Mike

    We were a party of 4 due to return to LGW on VS0016 departing MCO on 31st August 2007. The flight was cancelled. At the time we were told by VA ground staff in MCO that it was due to technical problems with aircraft scheduled to operate our flight. We travelled home on VS0016 the following day arriving at LGW 24 hours late.

    Following the advice on this forum I submitted 4 claim forms to Virgin and have now received their response
    We regret to advise that we have declined your claim on the grounds that the delay was caused by extraordinary circumstances that were beyond the control of Virgin Atlantic, and which could not have been avoided even if all reasonable measures had been taken.
    The aircraft that was scheduled to operate your flight encountered unexpected hydraulic quantity wiring indicator problems, prior to departure of its previous journey. After investigation by our engineers, it became apparent that extensive work would be required. In order to continue with our flying programme, an alternative aircraft was arranged to operate the outbound flight to Orlando, albeit with a delay. Due to the aircrafts late arrival into Orlando this had the knock on effect and delayed your journey back to Gatwick.
    This could not have been anticipated or foreseen. Technical problems stemming from events which by their nature or origin are not inherent in the normal exercise of our flying activity and are beyond our actual control are exempt from compensation. In addition, the cost of resources and equipment to eliminate this event would have been unreasonable.
    Based on the wealth of information provided by Centipede at the beginning of this thread I think the next step it to issue an NBA on the basis that the fault was not with our actual flight and that such faults are inherent in the normal activity of an aircraft carrier.

    Is this the right course of action? Any advice would be greatly appreciated but as you can see time is of the essence if we are not going to fall foul of the 6 year limit.

    Yes time is of the essence - I would just get on with it as you have a solid chance of receiving your just compensation.
