Thanks,
you both been really helpful. I am not at the stage of court action yet but want to gather my case together if it does go that far and this is really useful.

It's also a fair question to ask, in that is staff sickness a problem that any commercial operation has to face? Do restaurants close if the chef calls in sick? Does the bus company shut down for the day a certain route if a driver calls in sick?
And so on.
Staff sickness is a run of the mill every day event for all industry.
It's how it's dealt with being the issue for you. And reasonable measures ought to include a contingency plan to cover such events.
Do suitcases not get loaded if the truck taking them to the plane gets a puncture? Or do they have a spare one?
Etc etc0 -
Had mediation today. I did accept an offer so not a total waste of time. Not for the full amount but at least it means I don't have to deal with it anymore since it started in November 2012 a d don't have o pay any more court fees to take it to hearing.0

May have only been 3 weeks but it looks like it is just a std letter that they send to all? Maybe just to slow things down...
Hi psaila we were also on the same flight with an infant. We put in the claim and yesterday recieved a letter from virgin saying the have declined our claim because of extraordinary circumstances. Our scheduled flight had a technical problem being a oil leak from the engine so that had to be changed and there other plane was under repair due to a lightning strike and couldn't be used. Have you had any feedback from virgin yet? I don't think I will give up here as it seems they have fobbed us off with a answer that covers them and would stop us pursuing. Please anyone with any advice I would really apreciate it0 -

Hi all,
I have situation at Gatwick airport .My wife and son where travelling from Gatwick ,they check in on time ,aircraft left with couple of minutes delay, after some time in flight around 15 minutes , aircraft start having technical problems ,pilots divert plane back to Gatwick ,after emergency landing, thanks god everything good , they spent 2 hours in the plane, because ground services not ready to let them disembark aircraft after 2 hours of waiting finally bus take them to terminal ,no staff where available to direct them where to go or tell what's next ,bus driver told them where to go .So they went trough passport control ,and wait in the baggage claim area for another couple of hours until they got baggage back ,only then airport staff start giving them water ,£10 vouchers and start arranging hotels and next day flights . My question is can we claim something from airline for example like shock or stress during this emergency landing ,or delayed flights , I want appeal in court against engineering company who is responsible for checking aircraft before flight .
Please can someone advise me what is the best thing to do .Maybe some one can recommend good solicitors to call specialized in flights, planes or similar. I really appreciate your help or any advise given .
P.S.
airline offer them next day flight on 12.00 hrs. and flight is not direct with interchange ,original flight was direct . If you not happy you can take your money and no sorry for ruined holidays and biggest shock in your life , waisted time .
thanks in advance.0 -
Hello all,
I was just wondering if anyone had had success claiming their compensation when they were delayed because of a pilot being ill, and Virgin Atlantic using extraordinary circumstances?
I believe that virgin have claimed this many times, even at its home bases, and that they have potentially paid out, however I just want to double check?0 -
Hi welltravellediwish We flew with virgin from gatwick to orlando on the 8th of June and had a lovely holiday until the last day as we were ready to come home june 22nd we received a text from virgin saying our flight was delayed. We were delayed 27 hours . We put in the claim and after a couple of weeks received a letter from virgin saying the have declined our claim because of extraordinary circumstances. Our scheduled flight had a technical problem being a oil leak from the engine so that had to be changed and there other plane was under repair due to a lightning strike and couldn't be used. I don't think I will give up here as it seems they have fobbed us off with a answer that covers them and would stop us pursuing. Please anyone with any advice I would really apreciate it. Thanks0

The NBA has already been forwarded to VA, I sent a separate claim in letter form including receipts. There has obviously been some sort of misunderstanding at VA as I have received the decline of claims reply to an EU 261/2004, which wasn't my claim this time. I was claiming out of pocket expenses.
My fear is that letter and receipts may now be lost and my claim no use whatsoever.
With regard to the NBA, the soak period has not elapsed as yet so no court action.............yet!!
Quick update: I received an email today apologising profusely about the delay in sorting my oop expenses! The good news is that I will be reimbursed what I paid out LESS the prices of the alcoholic beverages I consumed with my meals. Fair one I suppose......VA must not be seen as to funding a habit lol!!!
The MCOL claim was issued yesterday by the way.........here's to hoping whoever makes the decision sees it from my point of view!!0 -

Hi there, great news that you got your expenses back.
Good news about the MCOL claim, do you know when the date for court might be? Don't be nervous just tell the court exactly what happened and how we were all treated etc. If you need any information about my experience and others on the flight font hesitate to drop me a private message, as hopefully it may add to your case.
Good luck0
