    Well a quick update and thank yous.

    Having completed the County Court form VA have settled out of court paying the full amount. They still do not accept responsibility but I can wear that.

    Thanks to JPears for supporting me through this forum, I probably would have given up ages ago and to Vauban for the invaluable downloaded advice and information as well as a cameo appearance on this thread.

    My sis who alerted me to the EUROPEAN regs and my Mum for posting the court forms and paying for postage whilst I was on holiday!!:j :rotfl::rotfl::T:rotfl:

    May I suggest you write a letter of complaint to the CAA pointing out that BA have both lied to you and broken the law by not paying compensation when it was legally due?

    Yes I claimed interest and the court fee. I will consider writing to the CAA as now I'm familiar with the regs, I'm confident that VA did not fulfil their obligations to me except the money once pushed into a corner. I found the whole process enlightening and empowering !!!128513; thanks again

  • I'm looking for advice please.

    My Virgin flight from Johannesburg to Heathrow was delayed 43 hours in April 2017.

    We spent two nights in an airport hotel but had to check in every day and spend the day in the airport.

    I managed to claim the EU compensation BUT should I be claiming more? The EU amount is small considering the inconvenience.

    Eu compensation would be 600euro per person. But you are also owed a duty of care so the hotel plus meals should have been paid form by virgin. You might be able to claim something on your travel insurance

    I contacted my insurers and they said as I got EU comp they would not be able to pay out.

    maybe consider that when you next purchase travel insurance...many only have a small amount...eg £20 for each 12 hour delay but if you need something more in case of delays you should be able to find a (probably more expensive) policy. There are people that have had similar delays due to weather etc that get no EU compensation but still have the same inconvenience

    Have a look at the terms and conditions of your policy and try and find where it says if you get Eu Compensation you cannot claim for a delay from the insurance company I would be surprised if you could find it.

    Agreed.
    Although insurer asked the same with my current easyJet claim. I told her quite clearly the 2 were not connected. She couldn't tell where this was in the terms and conditions.....
