    Has anyone has success with claiming from Virgin for VS75 21st October 2010? 4 hr 46 minute delay. My initial claim to the airline was rejected under number 24, category unexpected flight safety shortcomings i.e. 'extraordinary circumstances'.

    I was sent this explanation;

    The aircraft pushed back on time but returned to stand with a No 2 engine nacelle anti ice valve indicating as being unserviceable. Our engineers investigated the matter and the valve was changed, however the fault was not cleared and further maintenance was required.

    This part is classed as on condition so is only replaced when it needs to be. However I have gone back through our engineer's technical logs and there is no indication of th defect in the week before your departure.


    We were left sitting in our seats for those 4hrs and 46 minutes with very little communication apart from there is an engine fault on the tannoy system.

    After a couple of hours there were quite a few very restless and upset children plus tempers fraying with one or two passengers.
    We were offered one tiny bag of pretzels and one small bottle of water. Nothing else at all.

    I've sent the NBA off a couple of weeks ago. Worth pursuing with an MCOL ??

    The sad thing is, if Virgin had treated us like human beings I wouldn't even consider taking any action at all. However, being treated like ignorant cattle changed my mind !

    You may as well wait for the outcome of the Huzar appeal before making your next move. Hopefully, it will be decided for the passenger and so encourage airlines to settle cases like yours without court action.

    A big day for us is looming. We are a group of 90 passengers who were delayed for 26 hours coming back from Orlando on a Virgin flight in 2012. Of course Virgin cited 'Extraordinary Circumstances' so our case has been stayed. We now have to wait for the conclusion of the Huzar v Jet2.com case which is due to be heard on the 22nd or 23rd May. Should our case go to court it will be the biggest group to take an airline to court under EC261/2004. You can follow our progress on facebook with our community page 'Cancelled Flight VS016 271012'.   • VS074 7th June 2013, Orlando to Manchester, lots of members mentioning Horsham court date 10th April, (flor2012, haslehurst, Gjmickeylove, Natony46, lexie167, Oak1, Robster1302, goobervision, aall, scousekid), does anyone know any update since then? Or does the fact there is no update insinuate these cases have been resolved?

    I have not heard anything since the case was stayed.
    I believe we are waiting for the decision on huzar v jet2 also.

    I've just seen the date for the appeal is the end of May, should be an interesting outcome. as you say might as well hang fire and issue the MCOL based on the outcome of that decision. My NBA has been totally ignored by Virgin customer services, no response at all.
