Flight delay and cancellation compensation, Virgin Atlantic ONLY

Hi,
I'm hoping someone can help me out, we were on Virgin Atlantic flight VS016 from Orlando to Gatwick, it was due to depart on 26th at 2050hrs, but use to a technical fault we were delayed over night. Virgin provided us with a hotel and meal vouchers, but wouldn't give us access to our suitcase which caused great inconvenience as we were travelling with an infant. To cut a long story short as we are eventually boarding the flight virgin provide with a leaflet offering us 12500miles each. My first question is does the fact that virgin provided us with these miles that we are not entitled to claim under the EC ruling for compensation? Secondly, might sound like a silly question, but has anyone uses these miles before and are they as straight forward as 1virgin mile = 1 mile? ie. 12500miles round trip flight free of charge?
Thanks in advance,

not quite - details of the miles required for routes are here http://www.virgin-atlantic.com/gb/en/flying-club/spend-miles/reward-flights.html plus you need to pay the taxes (which on an economy ticket are the largest % of the fare usually)0 -
There was thinking "happy days" with these miles, but considering you need more than double what they give up to leave the UK... Better get the claim in then!0

Hi, i'm not sure if we have a claim or not because on our way back home from orlando (to manchester) a massive eagle flew into the plane... the pilot tried to avoid it but couldn't so we were delayed over 4 hours whilst the engineers tried to fix the wing of the plane as it was damaged (and covered in blood).
We were treated well and given meal vouchers but it did inconvenience us a lot with a 3 month old, 5yr old, 7yr old and teenage daughter.
I can't see anything about eagles flying into planes!
Many thanks.0 -
I'm new to this so please bear with me. A quick question. We were delayed from Boston to Heathrow on 4 March 2008 and arrived 4hours and 15mins after our scheduled arrival time. A part had to be flown in from Manchester to Boston to fix out plane, not sure exactly what and why it had to come from Manchester. A couple other things had gone wrong with our package holiday like a people carrier for 7 when there were 8 of us plus 8 suitcases! Problems with ski passes etc. So on our return we duly complained and received a £100 voucher for the whole party! Needless to say we were not impressed and never even spent it. We've now heard about the flight compensation rule, so am wondering whether the date when we initially complained is the true date of the complaint. We've sent off the relevant forms to Virgin this week but worrying about the date issue as we are 4 weeks over the 6 year rule if they disregard the initial complaint date. Can anyone advise on this as we are reading conflicting advice on the Internet?0

The 6 years in measured from the date of the delay. You can raise a claim with the airline for flights going back to 2005 however, for anything over 6 years, they can very safely reject your claim or ignore you as you are unable to take any court action unless you have started the court claim within the 6 years of the delayed flight.

3 weeks on since my post on 19-03-2014, still no sign of cheque from virgin. All I can do is keep asking Bott and Co. Really frustrating.0

If judgement was awarded to you at the end of last year, and you are still waiting for payment, I think this is unacceptable. I would be putting Bott under pressure to start enforcement measures.0 -
thought i'd share this, we were flying home from Grenada with Virgin and had to stop off in St lucia tto re fuel but arrived late and were told that there was not enough fuel so we had to stay in a hotel and resumed our flight 1 day late, i claimed compensation which was rejected as they claimed that under the regs they were entitled to do so as the lack of fuel was because of "war/political instability"well i challenged this as according to the foriegn office there was no such trouble. within a few days my claim was paid as they said that they had negotiated with the fuel supplier but still said that the original lack was due to the reasons they gave. the regulations also say that if they rely on any problems not to pay they have to show that the conditions did exist but as i'd been paid out i will take it no further.:huh:0

Good news for those on this flight that have not yet claimed.
I completed the reclaim form on the virgin website, posted to PO Box 4525 , end of Nov, and received 11 x £510 chqs in the post from virgin, during December 2013.VS15 10th May 2012
LGW to ORD
Delayed. 352 min
I’m new to the group.
Notice several references (#22,#74#303) to flight VS15 whichwas delayed by 352 mins, due to problems in Antigua. I believe a plane was arrangedfrom france.
I flew in a party of 13 , mostly family. Wondered if anyonehas so far had any successful response from Virgin. I’ve got as far asdownloading the claim forms from the Virgin site, ready to complete. Wonderingif I should start the long road ahead?0
