If anyone is claiming for VS015 on 22nd June.
I initiated court proceedings as they refused our claim. Prior to sending the court questionnaire back, we made a no prejudice offer to settle for £1900. Our claim was worth £2500 EURO.
They agreed to settle out of court, we have now cashed the cheque.
Happy with this as we have not had to go through the hassle of small claims court. Also it was slightly more than we would have got from a no win no fee solicitor.0 -

Was this the 2012 delay due to a malfunction of the flight planning software? As I've got a claim pending on a 23rd June flight that was delayed due to a knock on of your flight0 -
David - It was 27 hours. Cause was technical difficulty with the engine. The spare aircraft was hit by lightening so that was out of use too. They claimed extraordinary circumstances.
Foiled - No, 22nd June 2013 VS015. Flight eventually departed on the 23rd0 -

Thanks. Just shows how random their decisions to defend or pay out are! You might have thought that they would "have a go" with 2 potential (but still wrong!) EC arguments.0 -
We have just received notification from the court that Virgin are going to defend our claim. Not had sight of the Defence as yet.
Their reason was:
25. Unexpected flight safety shortcomings. Failure of necessary or required aircraft systems (for example the cooling system, avionics system, flight control system, flaps, slats, rudders, thrust reverser, landing gear) either immediately prior to or departure or in-flight (where those systems had been maintained in accordance with the requirement maintenance programme). Which part of the "extraordinary circumstances" criteria due to an unexpected technical issue coming to light shortly before our scheduled departure.
During the turn time in Miam, hydraulic fluid was found to be leaking out of the rudder area. As such, our engineers started to investigate the situation and carry out a full inspection. I can confirm the defect in question was not detected on a previous flight and there was no indication of such a fault in the previous week. The faulty component was an upper rudder middle actuator, which is a replace on condition item. This essentially means the part does not to be replaced until such a time where it is no longer serviceable.
Yet, in their previous letter it said in addition the landing equipment was unavailable in Miami. This is no excusable given Miami is a big international airport and one would expect to have this equipment available.
We were delayed 27 hours.
I guess the next step after lodging of the defence will be mediation?0 -

Well, if they agree - or get round to it. Sounds like they have a very weak case. As you say, I assume Miami is a large airport. Doesn't look remotely EC and a 27 hour delay suggests that they didn't do enough to mitigate the delay.

Just got our second claim back, We sent both together back in Oct and the first claim came back around 10 days later and the second lot of claims have come back today 6 weeks later. :j:j

Has anyone had trouble cashing a cheque? we took my brother-in-law with us and he's autistic so doesn't have a bank account so we can't cash the cheque. Anyone experienced anything similar?0

Hi we was due to fly on virgin but when we got to gatwick was told after 3 hours the plane was canceled due to snow and told to go home contact our booking agents to rebook. We flew out a week later, but this was due to agent had to rebook every thing. This cost extra as we had to pay for the rooms again.
We flew a week later but planes where flying out the next day. I sent the forms off and got reply from virgin and they have replied that due to extraordinary circumstance they refuse. Ps i should add we was driven to airport by a friend on motor way which was clear, and i had to ask they come collect us all again on motor way. Yet gatwick was close?? Personally i think it was due to staff not getting there, yes getting from my home to main road was a bit hard, but we still managed. But I can't prove this.0
