    Some advice for anyone facing a situation where J2 do try to impose a gagging clause you. Please remember that as Vauban has already said, you do not have to accept the inclusion any such clause. They would not be making an offer in the first place if they thought they could defend it. They can only gag you if you allow them to.

    For “Gagging order” read “confidentiality agreement”. A court has no power to impose such an order but the parties have power to agree one. The only time I would have ever advised a client to agree to such a clause would be if he was getting a deal in a case which might be lost if it went to Court or if the company was offering something in return, e.g. a higher figure.
    In most cases such an agreement is not appropriate and should be resisted. Or perhaps ask them, “If I were prepared to enter into a confidentiality agreement, what are you offering me in return”.

    Hypothetically speaking, it would indeed.

    I have just issued an NBA so will start court proceedings in a couple of weeks. That's if Jet2 let it go that far. I expect they will to test whether I am serious, which I am.

    Good for you. But it really is quite disgusting that Jet2 make their passengers do this. Tells you everything you need to know about what they think of your custom.

    As LBA is my local (preffered) airport I was gutted when Monarch collapsed, I was due to fly to Larnaca, Cyprus and Monarch was the only alternative to J2 - couldn't even go from Manchester with Easyjet so I've had to eat a nice hat. Grrrrrr

    The very unscientific poll I launched, did put them in second place behind Ryanair. I must admit - not a great advert for Yorkshire.

    My flight to Nice over summer was almost on time and uneventful. Even the aircrew were pleasant.
    EJ don't fly out of Leeds at all now. I wonder, with the collapse of Monarch we shall see some new flights from Leeds?

    Novice In Yorkshire too, although EMA is my preferred. That said, as I can’t stand RYR either, choice is limited.

    Monarch had some coveted slots so I am sure the lo-co’s and possibly the likes of TUI will be keen to get a share of the pie when the slots are sold off.

    I use to like flying from EMA but since all those average speed cameras have gone up on the M1 prefer to go from LBA and if you get back at silly o'clock the thought of driving home for an hour and a half is not very inviting.

    I think Thomas Cook have been looking at pinching some slots for next year, but with the hotel already booked I had to book flights quick before J2 hike prices even further as a result of increased demand.

    I must admit J2 have come to my rescue twice when the first time Ryanair cancelled on me and now Monarch, but when you know how bad J2 are it hurts to have to give them your compensation money back ;)

    I was lucky enough to fly with Virgin Atlantic last March and was extremely impressed, free drinks including alcohol throughout if you wanted it and plenty to eat - even afternoon T. Flight was on time despite torrential weather, the pilot had to do one of those starts, where they keep the brakes on and power the engines up before they release the brakes so you get a bit of a turbo boost.

    Blimey I'm going on a bit, I forgot this is a J2 flight delay thread oops - I'll be getting PM's from the admin team next, they've already messed my signature up :(

  • Thanks Tyzap. Brief background on my claim

    Strong winds in Nice on 24th July 2017 - westerly wind of 21.75 mph so not a hurricane - very similar to the westerly winds on 16th July 2016, and several times throughout the year- so I would argue not exceptional?

    The flight was diverted to Marseilles as there wasn't enough fuel to circle as the wind was due to subside. In Marseille after refuelling the plane's breaks wouldn't come off. Then when this was fixed, the plane wouldn't start. After 5 hours sitting on the tarmac they bussed us to Nice. Had they bussed us as soon as we had landed in Marseille we wouldn't have been delayed over the 3 hours. So I have issue with it not being exceptional nor the actual reason for our extended delay.

    This is my story so far:

    I sent the initial letter - they claim exceptional circumstance. I've disputed this (ping pong has started) then my last letter asked them for evidence of the exceptional circumstances. They have said
    "In accordance with our confidentiality and data control procedures, we are unable to provide the internal documents you have requested. Please be assured, however, that we have investigated your claim thoroughly on an individual basis and I can confirm that your delay was caused by adverse weather conditions (high winds) at Nice, which prevented landing there."

    So I'm wanting a bit of advise (hand holding) now on my letter before action. I've now read Vauban's guide. is it really as simple as copying the letter with my brief description?

    Check your flight number against Bott online. If they say you have a claim send a letter before action.
