I claimed for delays from Sept 2013 and last week finally received 598.00 , I tell you that
cheque was banked so fast ... keep going claimers , I had to write 3 times to jog them and had similar fob offs like others , but finally I have had success ... Am I the only person to actually
get some money of them ? :0 -
The first I've heard of Westbridge, well done. I've been at them for 2 years and still nothing, I'm stuck with the 2 year time bar at the moment .0

It may be a Jet2 case 111KAB, there have been cases on here where Jet2 have settled without legal action, not many granted I think two so far and another couple where legal proceedings have started...

I,m afraid I will have take issue here , I assure you I have received my compensation . I was about to write to them for 4th time to complain and a cheque arrived unannounced. I happy for anyone to use my Success as a precedent .0

It's only in the last few weeks that Jet2 have started to pay out, 111KAB has been here longer than I think anyone, and it has been a battle to say the least, just a bit of catching up to do on recent events, but yes well done and congrats on your win....

I wasn't offended , it's just a shame that Jet2 are not fulfilling their obligations . Other airlines are much better in this way , Jet 2 are a good airline and I have used them again since my delay . I wish success to 111kab and everyone else .0

The only issue remaining with Jet2 seems to be the two year limitation period that members are fighting, but even that although still in dispute, I can see a light ahead...
111KAB, Vauban, JP, Tyzap, Dr Watson, Mark2spark, Razorsedge and myself included are just a few that tend to hang around many months after either winning or losing our cases, just to help others, you can put 111KAB in the very first winners category, and we're forever grateful for these early pioneers that showed us the way.

Success in getting flight delay compensation from Jet2.
We made our claim in October 2014 only to be fobbed off with the delay was due to extraordinary circumstances.
We did not agree with this and as we had heard about a case pending in Liverpool we waited until that ruling was announced. When the ruling went against the airline concerned we replied to Jet2.
Here is the actual letter we sent with some details changed to ??? so that if anyone feels that they want to use our wording please do and you should get a successful outcome as we did with €400 compensation paid very quickly by Jet2. They even converted the Euros to Sterling at the rate of 1.38€ to the £.

[FONT="]In response to your reply to my claim for compensation, with regard to the ??? hour delay to flight ????? from East Midlands Airport to ???????????? Airport on ??th ????????? 201?, I have not received a satisfactory response to my claim for €??? compensation.[/FONT]

[FONT="]I understand the law and Jet2 have failed to demonstrate satisfactorily a reason not to pay me compensation.[/FONT]

[FONT="]Your letter actually states that the delay “was related to a technical fault” therefore I would like to remind you of the Wallentin-Hermann v Alitalia European court judgement which states the following:[/FONT]
[FONT="]This judgment set a clear test for airlines, which was that the cause of the technical failure had to be “not inherent in the ordinary exercise of the activity of the carrier and beyond the actual control of that carrier on account of its nature or origin”. In practice most independent experts concluded that the Wallentin judgment effectively ruled that delays and cancellations caused by technical failures were not exempt from the requirement to pay compensation. [/FONT]

[FONT="]I would also like to remind Jet2 of the Supreme Court announcement, made on 31 October2014, the Supreme Court announced that Jet2.com’s application to appeal “be refused, because the application does not raise of point of law of general public interest and … it is not necessary to request the Court of Justice to give any ruling, because the Court’s existing jurisprudence already provides sufficient answer”. Some legal commentators have suggested that this is now the end of the legal road for Jet2.com (and the other airlines), despite speculation that the airlines would seek to take their appeal back to the European Court. It is therefore now binding UK law that any technical failures are unlikely to represent extraordinary circumstances, unless they are caused by an event not inherent in the operation of an airline.[/FONT]
[FONT="] [/FONT]
[FONT="]The judgment of the Court of Justice of the European Union in Tui & others v CAA confirmed the applicability of compensation for delay as set out in the Sturgeon case. This has been subsequently acknowledged by UK courts, including the Supreme Court recently. [/FONT]

[FONT="]With the above mentioned rulings we do not accept your explanation for the delay as extraordinary circumstances.[/FONT]

[FONT="]As such, I am seeking compensation under EC Regulation 261/2004 for this delayed flight. As we were delayed by approximately 6 hours, therefore I am claiming €400, plus interest @8% p.a. Should you neither settle my claim in full nor provide a full and satisfactory defence to my claim within 14 days of the date of this letter, I reserve the right to issue legal proceedings without giving you further notice in writing.
