    Noted Tyzap, but the CAA have no power to force the airlines to do anything. "Expects" is not mandatory and the Birds are still trying to get cases stayed.

    Absolutely, which is why I believe whenever an airline does not follow CAA advice it should be reported to the CAA.

    They do have powers to act against any airline that continues to breach it's guidelines, but as we all know, have thus far refused to do so.

    The more cases that are reported to the CAA the better, eventually they will have to react. Till then all we can do is publicly embarrass them and keep chipping away!

    Yes, they have the option of appealing the decision and no doubt that is what they will do.
  • Even if they appealed the decision not to stay cases the judge could still give permission for cases to be dealt with and that would mean court cases until any appeal is granted??????????

    This is sightly confusing. This can't be an appeal in the normal sense, because it is not a legal principle or interpretation of a law that is being challenged, but rather it's effectively a case management decision. I'm not sure about how the mechanics of a case management decision create a binding precedent for other cases, or indeed whether the court service would write to all courts on the back of such a case offering guidance for future handling? Perhaps a legal expert will know?

    Vauban, this is not a legal experts view, it's my own view with advice from others!!

    Jet2 have asked the court to grant further blanket stays, based on the Dutch VDL case, on all cases that were previously stayed due to the Huzar case.

    Bott & Co will be arguing that this should not be allowed.

    If Jet2 lose this argument they are likely to ask the judge for permission to appeal. It is hoped that this will be refused, in which case Jet2 will probably appeal directly to the Court of Appeal (again) in writing. It is further hoped that the Court of Appeal would then also refuse their request (again) leaving them with no other options.

    As any appeal is a paper process, it should not take too long to run its course.

    It's an important case due to the fact that the Liverpool court decision, although not precedent setting, will become persuasive. In other words this decision will be followed by other courts.

    I will be attending the hearing, which looks like it is attracting a lot of interest and could be a pretty busy court room, and will report back afterwards on this thread.

    Somewhat pessimistic. Judges will be entitled to form their own views. Several have had enough of these delaying tactics

    Hence the importance of any decision being made at Liverpool, where most flight delay cases will be heard. There will always be the odd DJ, as the one at Cornwall if I remember correctly, who finds against the claimant for the wrong reason.

  • There's going to be a piece on flight delays and Jet2 tomorrow on Money Box. I don't know if it's relating to the VDL case.
  • Pretty sure it relates to VDL, but they haven't got back to me yet.
