    Yes RA have appealed the judgment, but courts should not be further staying cases involving RA because of this, just because they have appealed doesn't mean it gets granted...and interestingly none of the other airlines have appealed, which gives you an inkling as to the merits of this appeal.
    Do make some small amendments to the letter and ping this straight off to your court.
    Shame on your court....as poor as RA IMO.

    I have received a reply from the Court, the letter simply says "The Judge has replied that if you want the stay lifted, you should issue an application."
    i thought the letter formed the application to have the stay lifted, or am I wrong? How do I issue an application?

    Hi Pmcm,

    Take a seat and the good doctor will be with you shortly sounds like the Judge is being a bit of an !!!! to me, normally an informal letter to the court manager is all that it should take, a formal application IMHO should not be required.

    Mind boggling, your letter requests just that- for the stay to be lifted.
    If there is a form to fill in to achieve this, politely ask your court to inform you what the form is and to forward you one.
    If they can't because there isn't one, (not that I'm aware of) then again ask the court and judge to politely reconsider your reasoned request.
    If there is a form then do let me know, and of course populate it and send to your court.

    It is quite simply ridiculous, the form is an N244 http://hmctsformfinder.justice.gov.uk/HMCTS/GetForm.do?court_forms_id=484

    That's to make a formal application, but it really should NOT be needed, I would telephone the Court and be really nice, and ask if the Judge could look at it again, hopefully a different one, you could use the excuse that you wanted clarification on which form and the appropriate Court fee ?

    Just to add, I remember searching for the form when I needed my stay lifting, post Huzar, reading the historic posts on MSE, it looks like I found something that Centipede100 had posted and re-posted here http://forums.moneysavingexpert.com/showpost.php?p=65766030&postcount=1255 with credit to Centipede100 so it must be correct! ;)

    My Ryanair flight was cancelled from Faro-East Midlands (Wed 8 Apr) due to the French air traffic control strike.

    Ryanair could only offer a replacement flight from Seville to Stansted on Thur 9 Apr (my car was parked at East Midlands). The Seville flight was also delayed - due to depart 16:55pm - actually departed 19:15pm (again French air traffic was blamed).

    I incurred expenses totaling approx £300.00 (have receipts) for refreshments and getting from Faro to Seville and then from Stansted back to East Midlands.

    I am assuming I cannot claim under 261/2004 - but what are my chances under the airlines "duty of care"?

    I have just spoken to the court and they were pretty unhelpful. I was told that it was a judicial decision and if I wanted to apply to have the stay lifted I would have to fill in the form and pay £50 to apply!

    Looks like your judge is being a bit of an @*s*****, and you'll have to fill in form and pay fee. You'll get it back when you win.
