  • Thanks for this, really helpful. I think I might leave it on hold then for the moment, I could always try again in the future if the issue is clarified in another case. I did wonder if I was waiving compensation when I took the earlier flight... Thanks again for your help.

I today received a letter from Sheffield court stating "it is ordered that this matter be transferred to Nottingham district registry where further directions will be given". I was thinking I would, in a couple of weeks, complete the form where a decision would be made without Ryanair as per your extremely useful guide but just wondered what in should do now if anything?

    Another case of the court and possibly the judge involved making this up as they go along, and not the first I have heard of recently.
    Quite simply RA have failed to respond by the time they were due to.
    The court should now accept an application from you using this form to set the order by default in your favour:-

    There is absolutely no need for your case to be directed elsewhere for a directions hearing or anything else. ESCP is a very simple small claims process and one that the court should have no problem in following.
    Give Sheffield a ring and ask them why your case has been transferred to Nottingham for further directions and who has made this decision? Then tell them that you will be applying for judgment by default by using the appropriate form above.
    A PM is on its way to you with some detail you will find useful.

    Whilst she is in Sheffield today distributing maundy money, i'll have a quiet word with HRH to shake the UK court system up and get them up to speed with ESCP!

    My flight from Corfu to Manchester landed 3 hrs 45 mins late (FR2108 21.15 hrs 05/04/15) I recorded the pilot saying the delay was due to local weather conditions and I got an email from ryanair apologising for the delay blaming the weather and I wouldn't be entitled to male a claim. The thing is 4 other flights departing Corfu around the same time didn't suffer the same delay so are they lying to me?

    The other flights were:
    FR4012 19:15 to Bremen (15 mins early)
    FR5604 21.05 to Dusseldorf (on time)
    A3407 22.20 to Athens (on time)
    FR1803 22.30 to Stanstead (15 mins late)

    Surely if the weather was to blame it would have delayed the other flights.

    Do I have a claim and if so what are my chances if fighting on my own vs no win no fee?

    From the way you have described the events then yes I'd say you have a claim. If other flights departing from Corfu around the time of your scheduled departure all left there or thereabouts on time then, it sounds to me, that there wasn't any weather issues that RA can use as a legitimate reason to excuse them from paying compensation as per the regulation.
    Interesting that the pilot declared that the delay was weather related....
    Anyway, RA would have the reverse burden of proving such adverse weather affected the departure of your flight making it so late, and with other flights all taking off OK at the time of yours, this sounds to me like it would be impossible to prove.
    You can do all this yourself, my post #569 explains how. But if you don't fancy it, do give a good NWNF the opportunity to pursue this on your behalf.

    Hi,

    Just to add a little to what Dr Watson has already said.

    After a little digging around it seems that your incoming flight (to pick you up at Corfu) FR2107, held for a short while just off the coast and then diverted to Thessaloniki.

    No other aircraft diverted away according to FR24 and flight stats.

    The strange thing is that another Ryanair aircraft landed at about the same time (17.30) without any problem. Was there a quick cloudburst around this time or just after?

    Regardless, whatever the problem was it affected the previous flight and your delay was a knock on from that.

  • ...and PolishBigSpender has finally (after who knows how many flights over many, many years with Ryanair...) fallen victim to a significant delay with Ryanair. I was travelling from Rome-Ciampino to Wroclaw this evening, and the final delay was 205 minutes. If anyone is interested, the flight number was FR 9638 on 04.07 and Ryanair's website claims "ATC issues". As might be predicted, no-one else suffered from any ATC issues.

    My question is - what next? I've got print screens galore from flightstats showing that neither CIA nor WRO were subject to any issues, and also showing how the plane left WRO for STN this morning over 2 hours late (and returned to Wroclaw even later before going out to Rome.)

    Perhaps usefully, I've also got print screens from the Ryanair website showing how the flight delays were due to "operational reasons" when the first flight was delayed. The crew were also open, saying that they were delayed because of problems with crew scheduling in the morning.

    Should I go through the Ryanair claim system first of all, and what should I include?

    I've got in one big document -

    - boarding passes
    - print screens of virtually everything I could find about the delay

    Anything else I should get?

    (PS : can't find any route of the flight, but I was following the flight out to CIA and the only delay was that it circled a couple of times north of CIA before landing, otherwise it was a pretty direct flight out over the Alps)
