    Submitted my ESCP paperwork to Liverpool and have had the acknowledgement back and the receipt for the fee to process to the claim.

    Hi, just wondering if I could get some quick feedback on whether I have a shot.

    I flew with a party of 4 from Eindhoven to Stansted on 03/01/2015 on FR9272. The arrival time was meant to be 08:05, but at 04:45 they updated the estimated arrival to 11:00 (Yay for Google now's instant updates!). The flight departed at 10:14, and arrived at 11:07, 3 hours and 2 minutes late (Just, the pilot was speeding down the taxi-way, and yelled at the crew to get the doors open as soon as he stopped!)

    While we were waiting they told us the delay was due to technical problems with the previous flight, on their website it states ATC delay. I just got my response back from Ryanair and they've denied my claim saying:
    We sincerely regret the delay of your flight FR9272 from Eindhoven to Stansted on the 03/01/2015, which was due to adverse weather conditions affecting an earlier flight leg.

    Now, from looking through Flightradar and data, it seems that the previous flight would normally land the night before at Eindhoven. They were also clearly aware of the delay at around 04:30, >6h before the arrival time.

    The plane we flew on was the arriving plane from Stansted (FR9271). Normally our flight would have become that flight, but it seems they just didn't bother to try to get to eindhoven in time and just skipped our flight? Additionally, flights started departing from stansted at 6:30, so that plane could likely have made it in time.

    Is their justification of weather conditions affecting an earlier leg reasonable? Obviously flights can't happen during the middle of the night, but presumably they're arguing that they couldn't get another plane to Eindhoven in time? How can I possibly show they didn't take all reasonable measures without a roster of crew and planes!

    Welcome to the Ryanair thread and well done for starters for posting in the right place.
    Now, do you have a shot?
    You certainly do, your delay is over the threshold (just).
    RA have given you two invalid excuses to exempt them from paying compensation as per the regulation,
    1. Technical problem (and on a previous flight)
    2. Weather problem (affecting a previous flight)
    In fact you could argue its three invalid excuses as previous flight issues are not valid either.
    So as it says in my signature, my post 569 is your next stop on your way to claiming the compensation your party is due.

    Another successful operation undertaken by Dr. Watson making the pips squeak in O'Leary's testi***s once again.

    It wouldn't surprise me to learn that our Dr. Watson was able to turn wine into water overnight given the miracles he performs here on the Ryanair thread.
  • Hi all,

    So six years ago, on my birthday, I turned up at the airport, only to be told at the check in desk that my flight with Ryanair had been delayed by approx. 4 hours.

    I was flying to Dublin to see my girlfriend and subsequently found out that I was supposed to be attending a surprise party. I asked Ryanair to find me an alternative flight, they would not. I ended up getting a taxi to Bristol Airport and travelling on a new flight I purchased myself, to arrive in Dublin about two hours later than scheduled, not even using for the Ryanair flight, although I did check in.

    Just before the six year limit to all this, I started my European Small Claims case. So Ryanair have been dragging their feet a long time over all this, because of the appeals, etc. Finally, the Judge considered the written evidence last week, and dismissed the case!

    He wrote that I had not produced evidence that I attempted to check-in to the flight with Ryanair, nor that I booked with another carrier?

    I am going to appeal. I believe a signed Witness Statement should suffice to prove both the above, or I hope so, as I do not have proof of the other flight, nor of the taxi to Bristol.

    I do have the Ryanair flight booking that I used to return from Dublin two days after my birthday. Can I submit that, and suggest the Judge order Ryanair to confirm that I was on this return flight, just the same as they were able to confirm very quickly in their Defence that I was not on the outgoing flight?

    p.s. Yes, I already submitted the flight confirmation email fro the outgoing flight to the Court with my claim.
  • My own thoughts, since you need to put in an appeal today, is that since you didn't actually travel on the delayed flight, then you would not be entitled to compensation, sorry, I'm willing to accept that the good Dr is the expert in here, so I would wait to hear from a real expert, but I would be very careful about appealing without expert help.
