    I'm not seeking a refund for the second flight (as I didn't pay for a second ticket), only compensation for the delay and disruption to the best part of a working day caused by the second cancellation. Flybe hasn't said that I'm not entitled to compensation for the reason of 'one journey', the reason they give is Act of God.

    Your best bet for additional compensation could be through the ADR Flybe has signed up to.

    Thanks, yes since starting this this thread I have been in touch with AviationADR and they have sent the claim to FlyBe and I await their response.
    I'll post again when there is something to report.
  • Flight to Doncaster from Berlin early September cancelled. Flight rebooked for next day by Flybe.

    Received confirmation this afternoon we will receive €250 compensation and reimbursement of our hotel for the extra night and the evening meal! Thanks MSE and resolver!

  • First time I've ever looked at these boards, but am very regular here on MSE. First thing I notice/suspect is trolling behaviour unfortunately.

    That aside came here to post about a delayed Flybe flight. To cut a long story short, claimed using MSE template letter, full compensation received 29 days later, no quibble. Can't possibly fault that.

  • apologies if this type of information has been previously posted but i have initiated a claim with flybe for a flight that was delayed by 6 hours from Birmingham to Belfast and we actually landed in Belfast international and not Belfast city due to curfew on the city airport

    Flybe have claimed that i am not due compensation due to weather earlier in the day in London which delayed the arrival of the aircraft.

    i have exchanged 4 emails with no success or sign that they will pay up, is my next step NWNF claim?

    Have you put your flight details into the nwnf sites to see if they believe there is a valid claim?

  • Dear All,
    To anyone involved in a claim for flight delay / cancellation due to crew sickness. There is case law which has specifically ruled against this as being an allowable defence as an "extraordinary circumstance".
    You should quote Peskova and Peska v Travel Services which states " extraordinary circumstances refers to situations that are not intrinsically linked to the operating system of the aircraft, are not by there nature or origin inherent in the normal exercise of the activity of the air carrier concerned and are outside the airline's control.
    This is a three part test, thus all three parts need to be met for the event to be classed as an extraordinary circumstance. Crew sickness is an inherent part of the airline business, thus cannot qualify as an extraordinary circumstance.

    Also you can quote Smith & Collinson v British Airways ( Staines County Court 2015).

    If the airline refuses your claim you can apply to CEDR adjudication.
