And that neatly sums up Tui’s approach.
Firstly they ignore you or give you lengthy random deadlines for their response
Then the standard asnswer if you chase is along the lines of “we have considered and rejected the claim” using language that makes it loom pretty final
Eventually, if you persist they may point you towards CEDR and then they wait until the last minute at each stage to submit new reasons or make stuff up
In the end, if you persist CEDR will get there, and eventually TUI will acknowledge and pay the claim0 -

I would agree but surely that is for the Regulator to sort out. They must be aware that the Airlines are doing everything to complicate the process with the hope a good number will just walk away without pursuing through CEDR or the Courts. And in reality this is actually working as the Airlines must be saving a fortune in non paid compensation.
This will not change until the Regulator publicises information re each airline adherence or fines them/ or makes it more costly for an airline for each referral made to CEDR (like banks who I believe pay around £500 for each referral to the Ombudsman whether claimant is successful or not).0 -

I fund my regulator (by a considerable amount) but they certainly don't favour the profession that pays them, Quite the opposite, so I don't accept this arguement.

Can anyone help me with some advise?
Our flight was due to depart Mahon at 22.20 on 10th August 2018 destined for Leeds Bradford Airport. Flight was delayed boarding due to issues with the inbound aircraft from LeedsBradford. The week prior we had been delayed taking off from Leedsbradford due to a technical issue with the plane. An engineer was called from the Lake District to certify the plane was ok to fly! The delay was just under 2 hours so no complaint needed but I think there may have been a recurring issue with the flight/plane.
Boarding eventually commenced at 00.10 on 11th August but at the gate we were advised that the destination was now Manchester. The pilot told us that the plane/crew had been a rescue for a potential cancelled flight and that they had only just found out themselves that they would be returning to Manchester and not Leeds
Coaches were provided by the ground staff to get everyone back to Leedsbradford but it was 05.30 on 11th August, 5 hours and 40 mins after our original arrival time when we eventually arrived back.
TUI are claiming the flight delay was only 2hrs 21 mins (this is when we arrived in Man) and rejecting claim. Surely the delay time goes back to when we arrived in LBA?

It sounds like a valid claim.
You are quite right too, your arrival time is at Leeds Airport, not Manchester. Quite why they blatantly lie to their fare paying customers is beyond me.
No doubt the aircraft was directed to MAN because that is where it is based, it was probably rushed into service as a rescue flight to get you back to UK and save them having to put you all up in hotels at Mahon.

Base your claim on the basis that TUI will misinform, deceive and lie to you on the basis that 75% of your fellow passengers will accept their bovine excrement and not bother the airline any more.
