    What help are you looking for?
    All you have to do at this point is file your claim via MCOL; you don't have to do anything in anticipation of their defence.
    You will, of course, need to know the arguments against the technical faults defence should your case go all the way to court. You can find these in this forum and in the FAQs.

    I am currently claiming, on behalf of my Ma & Pa, against Thomson for a 12 hour (:eek:) delay in April 2011 for a trip to Orlando from Manchester.

    They have refused the claim, stating a bird hit the engine of the aircraft when it was en route to Manchester Airport and this explains the delay for my parents at the airport. :mad:

    From reading some other posts, it appears the consensus that a bird strike is not an extra-ordinary circumstance.

    Even if it is though, surely a 12 hour delay isn't justified?

    Actually hundreds of reports but this recent one gives you details of an acceptable turn a round time.

    Thanks for that. So a 3 hour delay for the people actually on the bird struck aircraft appears to be a decent time.

    As such, the delay shouldn't be any longer for those waiting to use the aircraft on it's next journey as in my case.
