Cheque received today although no breakdown in letter I calculated they are using present rates of exchange which means those of us with old claims lose out. Interest rate offered of 4% but watch out they are not including all court costs.
Consider interest rate acceptable, court would probably go with this and movement in exchange rates unfortunate, but not paying all court costs is not acceptable, so have rejected as I want all my court costs covering.
The court has given them until the end of the month to present a defence otherwise I will proceed. As the compensation is a fixed amount cant see how I would be worse off, the court will award all costs and probably interest at a minimum of 4% anyway.0 -

2 weeks after reaching agreement, my cheque has arrived, so have now notified Liverpool CC that all is settled with Thomson for our 18hr 47min delay (TOM2730) on 25th October 2009.
It’s 5 years since I sent my first letter to Thomson and what a journey it’s been! Every step of the way, Thomson have misled me, told me I had no claim and generally tried to fob me off.
Even in defeat, Thomson’s continued arrogance in trying to dictate the settlement and the fact that they didn’t have the decency to offer any form of apology underlines my determination to never fly with them again.
Without this forum and, in particular the support and encouragement of the regulars, I’d have accepted Thomson’s word and given up at the first hurdle. So a HUGE thank-you to everyone who has taken the time to read and respond to my posts, keep everyone up to date with developments….and add a laugh or two along the way - I can’t thank you enough.
To those still waiting, sit tight, your time will come...and when it does, make sure that settlement is on your terms, not theirs.
Merry Christmas to you all!0 -

I hope you are going to draw a line under the matter by writing a stinking, scathing letter to the MD or CEO of this "bunch of sad chancers" pointing out their dispicable attitude? If you're new. read The FAQ and Vauban's Guide

Really well done Kew73,
It does take both patience and determination to get through a long haul such as you have had, and you obviously have both by the spade load! It's a great example for others following in your foot steps.
You can relax and enjoy Christmas now.:jPlease read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
I've finally been paid after over four years of trying - only 4% interest but as it is enough otherwise that will do. No negotiation, just a cheque and they wouldn't enter into my attempts at an e mail conversation about figures. I'm quite satisfied but it sounds as if they are trying to get away with seriously underpaying lots of people, which is a hell of a cheek now that they are left with no defence (until they think of a new one!):( I hope that nobody is going to stand for this.
Congratulations to everyone who has got paid recently and good luck to everyone else.:T0 -
Well done and congrats gloriatabby.
Don't feel bad about 4% interest it's a fantastic result, and it sounds like your case was settled out of the Courts.
In my case I never claimed interest, expecting that if I was nice the compliment would be returned by an early settlement ~ how foolish of me!
It's going to be a good Christmas for you
Merry Christmas

Today I received a cheque in the post as full and final settlement. Hurray...but:
They have not consulted or communicated with me before this point following the removal of the court stay and... the cheque is for much less than my claim!
I am not accepting and standing firm. Why oh why do they 'apologise' in the short letter, ask that I 'consider Thomson again despite this issue' and yet simply rub salt into the wound and further destroy their reputation. I guess they just do not care... I see their chief exec has had a big bonus!
At least I now know they accept they can not win and are just trying to reduce the figure in the same bullying way as always.0
