If you haven't started legal process they may want to settle asap to avoid any further costs. I'd email back requesting an exact settlement figure ie exchange rate - see rip off in the post above yours. And fix a definite paid by date ie within next 14 days.

I sent off this morning a letter in the post of a NBA and also sent it via email to Thomson - this was at 11.45 am. I have just checked my emails and they have been back in touch with me already!!! they want to know if I have actually started court proceedings as in - instructed a solicitor or have taken it through the small claims court?

Looks to me as if they are running scared - well i'm hoping so, as the reason for my claim is they cancelled my flight 48 hrs before I was due to fly and put us on another flight two days later as they hadn't been able to fill the plane due to the previous swine flu epidemic. We were flying to Mexico and no one wanted to go.

Shall I just re-iterate what I have written in my NBA giving them 14 days to pay up?

This is interesting - I sent a similar NBA email yesterday (to customer.legal@thomson.co.uk) and this hasn't received a response (not even an automated one). I've also had no response to my snail mail letter of just under 3 weeks ago. Can anyone confirm that I've got the correct email address? (I got it from this thread I think).

Does sound like they might want to settle in your case before incurring extra legal costs etc. Good luck!
  • I had the same response and in the same time scale. That was three weeks ago. I have received two emails since stating that they will be in touch shortly and then that they would be in touch as soon as they can. I am still waiting.
  • Sorry that was meant for Bensonsmum.

Sounds like you do what I often do, get an email follow the link read the post and post a reply, before reading all the others after it!

I think Thomson are making attempts at sorting matters, but obviously, cases already in the Court system have to take priority, I would personally suggest issuing the NBA that gives them two weeks to deal with your case, after that start Court proceedings, you should get your Court fee back if Thomson settle, in the meantime all other 'letter writers' are still checking their post every day for a cheque.

I used that same email address that you have got TonyH2014 and received a reply - not just once but now twice today. The second email has basically said that they are now looking into my claim and will be back in touch with me within the allotted time-scale :)

Will keep you all informed of how i get on x

    Hi,

Just received a cheque in full settlement from Thomsons re flight TOM 893 from Bridgetown, Barbados to Manchester, due out 24 January 2011 and delayed 52 hours..

However I had claimed £1600 for my wife and myself which was based on the exchange rate at the time of our flight, my court fee, my allocation questionnaire fee, my hearing fee and postages plus interest at 8%.
Thomson's full and final settlement cheque payment of £1154, ' includes the value of your claim ( based on full price tickets purchased ), the court issue fee and accrused interest which we have retrospectively calculated from the settlement date at 4% back to the date of your delayed flight. If you have paid a court hearing fee, you must apply directly to the court for a refund '. ( The court fee I was claiming for was the hearing I attended in October 2013 and not for a future hearing. )

By my calculations, the compensation amount plus my expenses come to nearly £1300 without any interest. I will be writing to them declining their offer.

I wonder why they are mentioning ticket prices - surely that is irrelevant in law

    Indeed it is.

The regulation makes no comment about paid for fare classes.

The ladies name that emailed me back is [Personal details removed] - you could put it for the attention of her in the subject line???

It was [Personal details removed] that responded to my email 4 weeks ago. I did confirm that I had indeed started legal action and that my claim was stayed. They received a formal letter a week before that and I enclosed it along with a copy of my court letter.I am still waiting......
