    Would be good to see some news on a case date for the Dawson appeal.

    Stick with is people - all the information is all on here...it just takes some independent research and reading - you can't do this without preparation. (Seeing as the same people seem to be answering the same questions from months ago still...)

    Dawson is listed for either the 12th or 13th of May 2014 with a time estimate of 1 day.

    Though it currently has the appeal listed for 22nd or 23rd May, so depending on where Socrates got his information, it may not be accurate?

    Dawson and Huzar are separate appeals, about separate issues, which coincidentally are both coming before the COA in May (but not the same dates).

    I received Thomson's defence in the post today, dated exactly 28 days after the claim was issued.
    They STILL haven't given any reason for the five and three quarter hour delay to our flight. Their defence concentrates solely on their 2 year rule. It comprises only 12 points; 5 of these refer to the Montreal Convention. The last point states As to the contingent claim for interest, it is denied that 8% is an appropriate interest rate. I didn't claim interest!
    The defence is not what I was expecting, it's so flimsy and shallow I can't imagine a trained legal mind will be very impressed!
    I'll wait to see what the court's response to this is and what my next step should be.

    My husband was hoping to represent nine persons, in a flight delay,compensation claim,against Thomson,three of whom are children.
    We understand these children will need a litigation friend.
    I suspect my husband may not,also,fill this role.If this is the case,who will the court allow to represent the children?

    Your husband can fill the role as long as you all give him permission to act on your behalf, this is called a letter of authority, it needs to be signed by all claimed passengers. he will need to act as litigation friend to the kids, they don't need to sign anything. Make sure that all claimants are mentioned in the claim form and add the statement to be known as "Involved parties" or something to that effect, as the future reference to claimants as you dont want to name everybody every time. Why is the lead passenger not making the claim? it would be better.

    Actually I don't think this is true. The rules are you can only claim if the person is named in the claimant box (not just in the particulars), and there is a court form to complete if you want to claim on behalf of minors.

    Sometimes judges don't seem fussed - but sometimes claims are struck out or refused.

    As far as I am aware, the concept of "lead passenger" is a contractual matter in connection with the holiday/flight booking.

    The flight delay Reg entitles individual passengeres to compensation. I think that means that they have to make their own claim (albeit that multiple passengers can be named as claimants on a single claim).

    Although, as Vauban says, some judges are reported to be very relaxed about that, the safest way is to make sure a claim is done 'by the book'.
