    The main problem with being sarcastic though, is that you have to assume that the person you are being sarcastic about has a sufficient degree of intelligence to understand that you are being sarcastic. ;)

  • How long should I wait to hear about a claim I made for a delayed thomson airways flight to cancun. I wrote to thomson about 5 weeks ago and expected to hear something by now. Any ideas?

    Up to you how long you wait but 5 weeks IMO more than long enough so looks like an NBA giving the 14 days notice then a court application on the first day of 2014.

    I took the journey to my (NQA)L(AIUTB)DO. Still trembling with anticipation I handed over the card. The Postman returned with my Special Delivery. “The envelope, it’s a bit thick for an offer letter or cheque.” I thought, “unless… Of course! They have just sent me cash, small unmarked notes and all that.” (Yes, my imagination was running away with itself!).

    Then deflation. It was obvious. This was more from Them for their defence, and a pretty hefty addendum it was too.

    Narrator’s aside: It has been mentioned before on these forums and even occasionally encouraged. An order from the Court may say that all documents have to be submitted 14 days before the hearing, but for small claims, Judges seem to be allowing late addendums submitted by either side, particularly if they have been copied to the other party beforehand.

    “How dare they?” I thought indignantly. “This is an underhand tactic designed to derail my preparation for the hearing!” I followed that thought with several expletives. Then Dr David Banner popped into my head. “…don’t make me angry….. You wouldn't like me when I'm angry.”

    I went back to my car and stared at the envelope.
    My sensible inner voice was beginning to be heard. It said “Calm down, and remember your training.”
    But still, why have they sent this to me? I came up with this list:
    1. They are taking my claim seriously with this tactic.
    2. They have read my bundle statement and found something in it that they don’t like the look of.
    3. There is a gaping hole in their Defence and this is the plank they want to use to shore it up.
    4. One of Them has had a little panic about this.
    5. I have forced them to react to my actions for a change.

    I opened the envelope and quickly examined the contents. I chuckled to myself; all five of my thoughts above appeared true. I drove all the way home with a big smile on my face. Cancel the booking for Lou Ferrigno; bring me a cute bunny rabbit instead.

    Small Victory.

One of them, of course, is that it is an underhand tactic designed to frustrate and blindside you. But, even if that is how it seems, it might just stem from some error, omission or oversight on their part. (Does this happen to experienced professional organisations?). It might also be a reaction to something you have submitted. In either of these cases, take heart, you are probably heading in the right direction[/FONT].
    The above is just my opinon - which counts for nowt! You must make up your own mind.

    Sanford to Manchester July 2012 ,just received payment for full compensation for myself and 7 relations on that flight, just off to bank to pay it in (hope it does not bounce!) will write to court to tell them and close the book, thanks for all the help from forum,could not have done it without you.
  • Congratulations! Don't forget to mention full flight details in the Court Victory Thread.

    Obviously, wait until the cheque clears before cancelling the claim.

  • Just a quick update to say I received my cheque for £1326.91 :)


    After 4 letters from them refusing compensation due to exceptional circumstances (technical fault on earlier flight), the letter accompanying my payment now states the delay was due to operational issues!
  • Our flight TOM092 on the from Gatwick to Cancun was diverted to Bermuda because of a technical issue with the toilets. We were told one of the toilets had blocked. When we landed in Bermuda the problem could not be solved quickly enough so we ended up having to stay the night in Bermuda. We took off the following morning and arrived in Cancun almost 24 hours late.

    Do we have a case for compensation? or in this EC?
