Flight delay and cancellation compensation, Tui/Thomson ONLY

  • My wife and I were delayed by 5 hours on this flight and have made a claim for compensation upon Thomson recently only to be fobbed off with their usual Montreal Convention 2-year limitation interpretation. I am about to start court proceedings, but has anyone else made a claim for delay on this flight and had any success ?

    Quick update - my claim was transferred from my preferred (local) court to Liverpool where it sounds like District Judge Woodburn is handling all similar cases. Received a letter today to say that the case will be stayed until 30th May 2014 and that no later than 6th June 2014, Thomson need to provide an update on the applications and/or appeals and a summary of any decision of the Court of Appeal.
  • Razorsedge, I appreciate your comments re using my email address, but I purposely used an old business email address which is forwarded to my current personal one. Am delighted to report that two people have responded to my comments hereon. Anybody else please contact me. Would be interested to hear how others on either flight are progressing with Thomson in this regard! Mike
  • I received a small claims court judgement against Thomson Airways for a delayed flight in 2006 to the Maldives. I was awarded £1800.00 for 24 hours delay, and this included court costs & interest. The Judge worked out the amount and gave Thomson 7 days to pay. They did not send a representative to the court.

    2 weeks have passed and despite contacting them via email, I have heard nothing. They are 2 weeks over the deadline for payment.

    Any ideas as how best to proceed. Bailiffs seem rather drastic!

    Thanks. It's academic now as the court has written to confirm the stay. I have replied withdrawing my use of Huzar and asking for the claim to be reinstated.

    Appoint the Sheriffs and get them to impound a plane - by far the best way to go.

    As kab states, appoint Sheriff, bailiff's are pretty toothless. Sheriff can go in hard, bailiff can only !!!!! foot around. Costs are added to airline's bill. For £1800 from a company that has refused to cooperate I think you're being very restrained....;)

  • Heading off to court now.

    Received a bundle adendum last night from Thomson's (less than 18 hrs before the hearing). Funny how they think they can get away with that.

    I'll let you all know how I got on at some point over this weekend.
