Hi guys does anyone know of a no win no fee company in Scotland that deals with flight delays? Signed up with euclaims and got to the point for them submitting court papers, they then informed me they couldn't as they don't have jurisdiction in Scottish courts! Not confident enough to take them to court myself. Thanks x0

For what it's worth, I totally agree with your last point. I am likely to be in a similar position in the next few weeks. I would ask for a full hearing but I suspect Thomson will get the case part heard. Someone posted last week I think that they won at court but the Judge told them they would have to wait until the Dawson appeal had been sorted before he ordered Thomson to pay out. Just point out to the judge what Thomson are doing. They've already paid some out who got onto the delayed plane I got off and I will certainly be highlighting that to the Judge!0 -
Complaint to the information commissioner. Since Statute of Limitations is 6 years in UK, if they only keep records for 5 years then they are leaving themselves wide open to legal action from the individual over claims and from the Information Commissioner for failing to adhere to the data Protection Act.0

I sent a subject access request to Thomson who have refused it on the grounds that they only keep booking ref, confirmation for 5 years and so they do not have the information to give me.What next?
I would be grateful for any help.Thanks
Tigger if you booked in a travel agent they they will most certainly still have your booking on their computer and can print it off for you

I am currently trying to get compensation to a 24 hour delay in 2010 on a flight to the Maldives. Thomson are currently saying it's over 2 years so tough. However I first complained when I got back from the holiday in 2010 and was told there is no compensation policy? So as I see it the 2 years they are stating is actually a 6 year cut off period and even if they are right and it is 2 years, I did complain in 2010 and they ignored the law that existed at the time. I would agree with all on this forum, their customer service is shocking!0

I was on the Gatwick Flight on the 5th of December 2010. We didn't get any letter from Thomson. I have filed a claim with the court I am waiting the long wait. Thing is Thomson fail to realise that they could have dealt with it for a lot less money at the time. They could have just been honest and upfront about the rules. I have not had substantial delays with scheduled airlines but have been downgraded and they just deal with it, in an honourable fashion. Thomson have annoyed soooo many people.0 -
I don't think this has been posted yet, but the Dawson appeal is listed to be heard on either 12 or 13 May 2014.0

My flight was delayed over 7 hours. At the time Thomson said that a part was faulty and that they had to have one flown out from the UK. A few hours later they said they had fitted the new part and that was also faulty and they were going to get a further one flown out. This was fitted ( eventually ) and we finally got on the flight.
My question is: Does the fact that a they had two faulty parts strengthen or weaken Thomson's position on trying to claim EC.
They don't mention this in their defence ( as yet ) but that was what they said in the anouncements at the time.0 -

If you go to Court depends upon the judge but in my eyes makes them look like amateurs who don't know what they are doing. If it happened when you took your car for a service and they kept it in overnight you would be asking for a loan car.0
