I disagree with their assertion that the flight arrived 1 hr late when in fact it was a day late! Slight mistake on flight stats (i put the wrong date in) There is now no data for the actula flight ever having taken place.

They probably think you were supposed to land on 7/2/2010, whereas you are working off 6/2/2010.

It sounds like they changed the flight time at some point in time.

Were you notified of the flight time changing? On your booking docs what is the scheduled departure and arrival times?
  • We were supposed to land on the Sunday at 450pm but arrived back at 2pm on the Monday. It was an hydraulic leak apparently found when the plane landed to collect us that caused the delay

Just reregistered with mcol as got nowhere with thomson on the phone again.

Can someone help with the interest loss please? Do I put it on my claim? Is it 8%? The delay was from sept 2011, so is it worked cumulatively daily or cumulatively monthly from sept 2011 to July 2013...amount is £345 x2.

    That explains it.

Thomson will be Defending the case by saying the following happened:-
You were scheduled to arrive 16:50hrs on 7/2/2010, but in fact arrived at circa 17:50hrs, just 1 hour late.

    What actually happened:-
They cancelled your flight on 6/2/2010 and rescheduled it for 7/2/2010.

You need to be careful with these types of claims because strictly speaking they're cancellations (with re-routing) and not delays.

To win the case you're going to have to:-

    1) Prove the scheduled departure and arrival times; and
    2) Draft a good witness statement explaining what happened, with a chronology of events.

8% from date of delay .... work out daily interest. You don't provide a September date but I am sure you can work out the number of days from then until the day you submit MCOL.

Delay was 10th sept 11..I work out 688 days from that day to today.

    So is it 8% £345 = 17.25per annum (?), which is £32.52 for 688 days x2 persons = £65.04 + 690 = £755.04 total?

8% of £345 is £27.60 p.a. Divide this by 365 days in the year = 0.0756p per day so multiply this by 688 days = £52.01 interest on £345 however to start off with where did you get the £345 from?
