    AEQP = Aircraft Equipment ~ looks like in your case they swopped planes.

    The plane they were working on was the plane we took, pilot also apologised for delay and what the cause was.

    Well this seems to be at conflict with the flight-stats analysis insofar as your post indicated an AEQP from ? to a B763 which is a stretched Boeing 767-200.
    Might be worth examining plane registrations for the day/route in question particularly if you are sure there was no plane substitution.

    I sent the NBA a month or so ago and waited for my parents to arrive back from their latest holiday (I'm claiming on their behalf).

    Just as I was about to start MCOL, my mum flippantly drops in that they have FINALLY received a written reply from Thomson. The content of this letter being they are reviewing the claim again since the initial (phone call) rejection they gave my Dad nearly three months ago stating a bird strike was classed as EC.

    This would have been after they received the NBA.

    Options thus are;

    1) They are realising the cost and time of completing court forms is onerous and thus are reviewing any NBA follow up claims and may be willing to pay up after such a review.

    2) They are merely delaying me further in the MCOL submission.

    Has anybody else had been through similar...?

    (Of note, I did submit online to CAA to complain about the rejection and the lack of written correspondence from Thomson. They replied saying it is really hard to give an opinion when Thomson haven't written to me, so when they do provide written confirmation, to get back to them with it! :mad:)

    It's the same letter they're sending anyone who writes a NBA. I'm not aware of any evidence of them revisiting their decisions, once they've declared an EC. But carry on writing if you think they might.

    You are free now to start court action, so the airline is delaying nothing: it's your choice.

    Hi, I have a couple of questions to help me fill out my compensation form. I booked a package holiday with Thomson flying from Edinburgh to Sharm El Sheikh on the 22nd of June this year. This flight was delayed by 6hrs but worse than that the return flight on the 29th was delayed by 17hrs and we received terrible service from the local reps.
    My questions are as follows:
    A) Am I entitled to claim for both delays?
    B If so, do I detail both claims on the one form or put them on different forms with a covering letter?
    C) Should I also include my complaint about the local rep on the compensation form or is it a separate issue?

    You were quite right, received the directions questionnaire yesterday.
    The court accepted Thomson being late with their defense by four days.

    I haven't kept up with this thread in the last few weeks.

    I do have a legitimate argument (our flight was delayed as a result of something happening on another flight, EC BLAH BLAH BLAH)

    Sent off first letter, took them 56 days to respond with their Bull S

    Did the 2 week NBA, no response

    Reg with MCOL, and was browsing this thread making notes, til someone pointed out that one must write to the Company Sec (this should be more explicit on the faq's, IMO, as the other poster didn't realise either)

    Wrote to co sec about 4ish weeks ago, no response, til a letter today saying:

    'following change in regulation, thomson is obliged to fully investigate..'

    Now, anyone else had this?

    Was planning on MCOL, but would rather save time, money and hassle, and wondered if it was worth waiting (I'm in no rush, but WILL commence MCOL if it came to it)

    There's absolutely no requirement to write to a company secretary.

    I suspect what that person meant was that Court Proceedings should be served on the registered office of the airline.

    If you're using MCOL then you do this by entering the registered office in the Defendant section of the claim form. The Court will then serve (send) the claim form to that address - in effect 'writing to the company secretary' for you.
