We have had the Allocation Questionnaire last week for our claim and Thomson state that they are having two witnesses. Who could that be? It's say how many witnesses including yourself so I guess the guy who signed the form will be a witness?0

Another thing. The AQ had no space on it to ask for information from Thomson. I thought there was a box on the form for doing that. It was a form N180 Directions Questionnaire0

Woman who signed all the forms etc prior to my hearing was not present at hearing - only the barrister appointed by the airline.0 -

Quick Google cites a Barrister from £150 an hour. Take that of £400 take off the wages spent by Thomson administering the claim. Not a big saving really0

'My' barrister - 1.5 hours night before, 3.5 hours at hearing + travel expenses so 5 hours then case adjourned. Informed his charge between £75 and £300 ph (he would not be more specific) so taking say £100 ph means £500 absolute minimum and the solicitor prior has produced all the evidence, declarations etc etc and spent one hour on 'phone for mediation. Case has to go back to Court again (court allowing 2 hours) - my claim is 250€ x 2.0 -
Lodged my claim with Thomson 6 months ago and after 56 days recieved the standard "exceptional circumstances" letter. I wrote back to them to tell them this wasn't acceptable and quoted (as they did to me) a few cases that showed I was within my rites and due compensation.
Have now after another 56 days recieved a further and they say "final" reply which is just a load of waffle.
"Keeping an eye on the purpose and spirit of the Regulation and doing that while continuing to deliver real value to our customers is a challenge that can only be met by applying the law robustly and not making payments where there is no entitlement. If we didn't apply the rules in this way, prices would need to rise for you and all other customers.
Thomson Airways operates a fair and thorough process to deal with claims for delay in line with the regulation. The law in this area is complex and many situations will not result in an entitlement to compensation. We are not obliged to release any further internal information surrounding your delay. we are sorry etc.etc."
Is it just me or is that complete and utter waffle and basically " we don't like you so we are taking our ball in" ?

it then goes on to say that the amount claiming has been paid see attached form N9B which is not attached
it then gives me two options one to proceed with claim or two I do not wish to proceed with the claim and send a copy of the completed form to the defendant .This is not what I was expecting to receive and I havent received an allocation questionaire as goooseman did

Why is your case taking so long? I thought Small Claims were heard in about an hour and judgement is passed. So for £500 Thomson are already in the negative with your claim? If you lose they are in the negative and if you win they are in the negative.0
