    TCX2039 From Tenerife South to Glasgow on 19th Oct 2012. Delayed 11 hours and then passengers split into 2 replacement planes.

    Finally receied a cheque for £1435 for the 4 of us this week after TC's usual delaying tactics. Even now they have never answered any direct questions that they were asked. They have also breached data protection and have conveniently chosen not to answer questions about this too.

    Thanks to all the guys on here for the advice and the templates.

    This is the issue I have. They have point blank refused after 2 letters..one of which was an NBA...so I guess MCOL is the route now. It is frustrating really when it was engine failure and we were on the plane at the time and turned back and waited 23 hours. Yet I read on here people getting compensation for 6 hour delays.

    Everyone is worthy of compensation...it is just frustrating that some are getting it easy with smaller cases.

    Do I have a claim if I did not contact Thomas Cook within 48 of my delayed flight?

    I have received my second refusal for compensation and was now wondering if it was worth taking it to the small claims court?

    Kevster - I assume the '48' you mention is hours not years (although with the TC planes I have my doubts!) in which case they are totally in the wrong and they know it. Please read the FAQ's and you will see you have a very good case against TC. Whether you decide to pursue this yourself or use a no win no fee firm (but lose c.30% of any award) is up to you but either way you should not walk away.

    Sorry for the mistake! As you guessed it should of been 48 hours, but on review of my letters from TC they are saying I did not complain within 28 days as per their small print. If I send them a letter threatening court action how likely is it that TC will settle out of court? I haven't found a definitive answer to this on the forums.

    VERY VERY unlikely as they are just wasting your time however the 28 days seems to suggest you are writing to the holiday company as opposed to Thomas Cook flights. As I say read the FAQ's - make sure you are writing to the correct people/address > if you are decide whether to take on the matter yourself after NBA or go to a no win no fee firm.

  • I got a letter from TC on Friday with a voucher for £726.00 in it (despite making it clear in the past that I wanted a cheque). Not sure how they got to that value, there were 2 of us on the flight and the distance is 1590 km. Any ideas anyone? I can't work it out I'm afraid. I will be ringing them tomorrow to request a cheque.

    Basically I just badgered them for 4 months, ending with an ultimatum of 14 days or Small Claims Court, and then sent regular updates via the customer services website counting down the days. Eventually they asked for a postal address from me, which I assumed would be to send more letters begging for extra time due to the complexity of the case. Imagine the grin on my face when I opened the letter!

    Many thanks to all the dedicated persons on this forum who undoubtedly helped me win. You lot are stars.
  • Additional - I just rang them to request a cheque and was told that I need to ask for this in writing and it can take up to 28 days to sort out! Even when they admit defeat they can't be gracious.....

    I have looked at various websites and can only find the departure time from Glasgow which was 13:58 (against scheduled departure time of 10:05). None of the websites show the arrival time at Heraklion.

    As the flight left almost 4 hours late (3hours and 53 minutes) I'm guessing it's unlikely that it made up the 53 minutes. I'm fairly certain it was after 8pm when we arrived in Heraklion as it was after 9pm when we arrived at the hotel and dinner had finished so we ended up with bread, ham and cheese ... and I hate cheese :(
