    Still not clear which airlines are involved in this. For the original flight, the rearranged flight, and the actual flight. What have Flexible Trips got to do with it?

    But it sounds as though you are due EU denied boarding compensation from the operator (airline) of the early morning flight. You are not entitled to your fare back as well since you did travel

    By copy of tickets do you mean you were emailed another e-ticket when they informed you of the change in time ??

    If it was and they can't prove that they notified you of any changes since then you've probably got a fairly clear right to compensation due to being denied boarding ;)

    Thomas Cook use a company called Flexible Trips to help them fill their planes. We booked totally with Thomas Cook. The day we booked we got documents confirming our bookings but when tickets came via email the times were different to our confirmation docs.
    We went to the branch and they told us its due to the later flight not being full.
    So we only had one set of tickets showing the 6:55 am flight which Thomas Cook told us Flexible Trips had not updated on their systems.

    It seems Thomas Cook use Flexible Trips for admin purposes.

    So, we were stuck in limbo for 12+ hours.
  • I tried to have my say but it looked from the first moment that the Judge did not think that the Small Claims Court was the place for this case to be heard. I must have had about 5 minutes to speak in the whole hearing and when I did try to quote knock-on's and other points of law the Judge just did not want to know.
    I mentioned about why Thomas Cook could not get another plane to fly us home but he just agreed with the defense's argument that it would have cost too much. I just felt during the whole hearing that I did not have a chance. He took everything that Thomas Cooks solicitors had in their defence as gospel.
    I will try to get a transcript and I have sent a message about this to BBC's Watchdog. I'll have to see if anything happens.

    Sounds tough. What did your skeleton argument document say, and what did you put in your bundle?

    I got an e-mail from bott and co a few days ago to say that they are now serving papers to the court. Yet the person I was travelling with has received an e-mail to say that Thomas Cook want more time to investigate it and will let us know shortly after more investigation, yet it is exactly the same flight. So i'm staying hopeful unless they are binding there time even with the solicitors on board, but if you can work it all out you are lucky

    Were you just claiming for yourself or others as well?
    If the latter why not start over and apply to a different court.

    As clearly the judge is out of touch if you included in you bundles the relevant points ie paragraph 18 to 24 then he has no argument to refuse the case as a previous poster has said if he believed the case should never have been heard I would ask why it was excepted and would request a refund

    Assuming your flights, both the one you were denied boarding for and the one you actually flew, are with Thomas Cook, that is the party you need to contact for compensation. The fact that an error was made by a third party is not your concern.

    You should have a read of the dedicated Thomas Cook thread, https://forums.moneysavingexpert.com/discussion/4384693

    Then write a post outlining the relevant facts, then send Thomas Cook a letter before action.

    It sounds like you were denied boarding, then re-routed by the airline at a later time. You are probably due $400 euro compensation.

    Thanks to everyone for the replies...I am now more confident that I'm not being unreasonable and will pursue this to the end..ill update you when I hear anything.
