    I think I'm gonna go through a NWNF company so I'd be grateful if anyone could recommend one who specializes in this field. Can I send a NBA letter to TC first or would I be better leaving it to the lawyers?

    When we were flying out to Corfu the plane we were due to fly out on had just flew in from Zante. So I checked the aircraft reg numbers on a flight tracker each week for the Corfu flight and it was always the Zante plane that flew out to Corfu. I then checked for our delay and the Zante plane landed at 9.30am and then flew out to Menorca at 10.30am for their delayed 7am flight.

    My argument is that there is no way the Zante plane scheduled to land at 9.30am could have been scheduled to fly out to Menorca at 7am so our delay was caused by Thomas Cook transferring our plane and could have been avoided.

    The problem with that is that they can (and often do) swap out aircrafts as needed. It's not set in stone. Not a solid argument. My flight is usually flown by one of two aircrafts though sometimes it was flown with a larger one or an alternate one.

    Any posts regarding any other airline in this thread will be ignored (at least by me).

    Unexordinary circumstances don't sound very special ...

    Read the FAQs on page one as a starter.

    I was on tcx2502 Manchester to Antalya in October 2012.

    When we arrived at Manchester Airport we were told that 'due to problems within the Thomas Cook fleet' we would be flown to Dalaman and then bussed to Antalya Airport.

    Consequently we arrived at Antalya Airport approximately 5 hours later than we should have.

    Does this sound like I have a decent case for compensation ?

    Yes. This is code for "we've used your plane elsewhere", which is an operational decision on their part. Strong case for compensation.
  • After half a dozen letters, and knockbacks from Thomas Cook, and then a No win no fee company taking my case and then telling me its not worth fighting, i thought about giving up. I didnt, and carried on with another 2 letters. Last weekend i rang again after getting another letter from Thomas Cook asking for more details. Got a bit of a shock when they offered me £1042 :rotfl: I refused a voucher, and was told they no longer send cheques. They took my details to do a bank transfer. The money has now cleared :beer:
    The morale of this tale is never give up the fight. Thanks for all the tips and posts that have helped along the way.:T

    TC have acknowledged at MCOL & are going to defend, which I expexted at theis early stage.

    Apart from starting to learn the various rulings backwards.

    I have also been onto TC's website if there is anything there that may also help http://www.thomascook.com/thomas-cook-history/

    They appear to have virtually no room to manoeuvre should anything go wrong.

    "Thomas Cook Airlines operates a fleet of 35 aircraft from 21 regional airports to destinations worldwide"

    Presumably there will be at least one plane on the ground for servicing???
